There's no plagarism on their part. I personally don't think the two songs sound anything alike, but what do I know. If indeed it is similar it's likely from "influence" petty had on them over time subconciously.

I hate artists who say "I don't copy, or I don't imitate". Well, if you think about it all artists are merely playing what they know based on earlier stuff they were exposed to and influenced by.

I noticed that the first time I listened to it.

the whole album is very tom petty and byrds influenced, but that one song is VERY similar. I'm no music lawyer so I don't know if it qualifies...But I'd just chalk it up to "influence" rather than "plagarism"

It's the melody that gets artists in trouble, not chord progression. Nothing is gonna come of this.

The claim is that the melody is the same as well.

Huh.. Didn't really pick up on the similarity to now. But regardless, there's a ton of great work on the new CD.

Wow, if you listen to that mp3 in the link they're pretty damn close. If that's not plagiarism, it's about as close as you can get.

Wtf.. It IS the same. You'd have be completely dense to not recognize that. It's pretty obvious that it's intentional too.

Edit: I'm listneing to the full song, and overall it sounds more like the rest of their songs. I think I've heard it on the radio and didn't notice.

I thought the title meant that the RHCP's were in trouble for copying themselves, since the new stuff sounds exactly like everything else they've done since they got popular.

Its pretty much impossible to come up with a NEW chord progression that has never been done before nowadays. There's always SOMETHING that sounds similiar to something else.

Its not plagiarism because the whole song doesnt line up perfectly with Tom Petty's. They start off with similar ideas, granted, but the Chili Peppers do something completely different with it when it comes to the pre-chorus/chorus. I don't think Flea, John Frusciante, Chad Smith and Anthony Kiedis were sitting around one day going "Sh!t, we need another song... An awesome one for a single. I know, let's steal from Tom Petty. Hmm, Free Fallin'? Nah, thats been done to death and used in that crappy Jerry Maguire movie... Let's do "Last Dance With Mary Jane". People won't notice then..."
