If the nation escalates to "red alert," which is the highest in the color-coded readiness against terror, you will be assumed by authorities to be the enemy if you so much as venture outside your home, the state's anti-terror czar says.

"This state is on top of it," said Sid Caspersen, New Jersey's director of the office of counter-terrorism.

Caspersen, a former FBI agent, was briefing reporters, alongside Gov. James E. McGreevey, on Thursday, when for the first time he disclosed the realities of how a red alert would shut the state down.

A red alert would also tear away virtually all personal freedoms to move about and associate.

"Red means all noncritical functions cease," Caspersen said. "Noncritical would be almost all businesses, except health-related."

A red alert means there is a severe risk of terrorist attack, according to federal guidelines from the Department of Homeland Security.

Sorry but that would be unconstitutional. Unless I read the constitution totally in correct they can't suspend your rights unless we got invaded. Also martial law can't be declared by us president due to a case about 40 years ago don't remember the name of it. Also I will go outside and dare cops to arrest me if they do I will sue the government for violating of my constitutional rights. Unless are attack they just can't suspend them!

p.s. allof my guns will be loaded in the next 20 min

I stated a while back that we are slowing losing our rights. When the government stepped in to do searches as airports they started to violate our constitutional rights. It is illegal searches going on at every airport. Of course no one cares because it makes them feel safe. The terrorists started winning the moment we started trading our constitutional rights for "safety".

"The Constitution just sets minimums," Scalia said. "Most of the rights that you enjoy go way beyond what the Constitution requires."

This is what he said today.

I can't beleive you take an article seriously that has the phrase "state's anti-terror czar" in it.

well i am not sue if they are violating our rights. It don't see specifically in constituion that they cann't do it and cogress has the power o pass any laws needed as long as it don't violate the constitution.

what the heck is wrong with you guys. If its deemed necessary that there is enough speculation that somethings going to happen, I'd happily be confined instead of out in it somewhere.

its for our safety guys, I don't see a thing wrong with it.

Am i the only one that feels like, if there is a red alert, i'll CHOOSE to stay in my home, near my family?

shoot. if there is a red alert and there is any kind of panic in the streets, you can bet your ass i'm blowing off work or whatever else needs to be done so i can be home to protect my family.

i don't need any law to make me want to do that.

You might want to read a little about what President Lincoln did during the American Civil War. Your rights can be suspended during a national crises, state of war, etc....

It doesn?t matter if it?s for out safety or not they constitutionally can't do it period. Now they can advice people to stay home, they can shut down public institution but they can't shut down public businesses unless we have civil unrest, then they can declare a curfew until unrests is over and then they have to lift it. I will sue them if they attempt to take away my civil rights.

They that can give up essential liberty to obtain a little temporary safety deserve neither liberty nor safety.
