Skimmed a couple of articles. Didn't see why she started recording in the 1st place.

It's simple, because she was in her private property (car) and can record whatever the hell she wants in a public place while inside her own private property.

We've seen videos where the citizen is intentionally being dicks. Curious if she had an agenda or was concerned for her safety.

Maybe because cops seem to have an increasing tendency lately to shoot people for no reason? Just a thought.
 
Cops really should be an explicit exception to any recording laws while on the job. You want to enforce the laws? Welcome to the microscope.
 
Hell, as a pre-requisite to interacting with police, I'm inclined to say up front I'd like to record the interaction. Chances are, the officer's response will indicate the type of officer they are right away.

He argued with her for 4 minutes, he knew he screwed up. I can't imagine a cop doing that is they're in the right.

Don't cops understand that there's no expectation of privacy if you're in a public space? That's what they've been telling John Q. Public for the last decade.

These HOV tickets are BS. I-95 backs up and the HOV lanes go wasted. As taxpayers and voters it was never presented that these expansions would have special lanes, plus in some sections you have toll lanes that are actually part of I-95.

Police are becoming enforcers...not protectors.

33-year old Brandy Berning was pulled over by Lt. William O’Brien after she reportedly drove in the HOV lane at the wrong time.

As O’Brien approached her vehicle, Berning hit the record button on her phone. She recorded about 15 seconds of the conversation before telling O’Brien that he was being recorded.



That’s when the deputy told her she had just committed a felony and demanded that she hand over her phone.


Berning refused.

Yea they dropped charges after they made her spend the night in jail. Guess the tax payers will be footing this bill while the cop gets a paid vacation during the internal review.

Since she committed a Felony why was she released after an overnight stay in jail, she should still be in prison.

That was actually the closing remark in the news story video, that despite his insistence that she committed a felony, she wasn't charged with a felony at any point.

You're right that she had the right to record the conversation, but you are wrong about the reason.

She had the right to record the conversation because there is a law in Florida stating that citizens have the right to record the actions of a police officer performing his or her official duties.

Without that law, she would have been required to provide notice of the recording, even if it were occurring on private property.
