More than likely, you're going to get stuck with it, but if you have a decent judge, he might see things your way and just ask to make sure that all reparations are made, blah blah blah.

my insurance took care of all that. I just don't understand why I am being punished for something that I could not avoid. About the only thing I see as being my fault was the fact that I owned a cheap P.O.S. '91 ranger that had poor traction (even though the 75,000 mile tires have 70,000 miles left on them). I ended up selling the truck afterwards and buying a '97 dodge dakota sport 4x4 w/ ABS.
like you had said, the roads were slick and it was raining. if you try to fight it, the judge or prosecutor/DA will ask you, why weren't you 200 feet back? or 250?

And I will shoot back, "It's near impossible to get anything more than a 150-foot gap between you and the car in front of you on the city's busiest 4-lane road(Kimberly Road in Davenport, Iowa) at rush hour on a weekday"

I can see there's no point in continuing this. You're the type of person who would get fat and sue McDonald's.

I don't think that the OP is actually delegating fault onto someone else, just trying to say that it was an impossible situtation to avoid. I dunno, I wasn't there.

In the snow, gearing down as well slows you down faster than just simply braking. Maybe it's the same in lots of water?

lol... if it happens to you, tell that to the judge. i'm not saying that it doesn't suck, but i'm trying to address what the judge will do, and the judge isn't going to be like "that's ok, boys will be boys! 😉". i had a guy rear end me when i was driving a pickup in traffic on a busy street on dry pavement. he stomped on his brakes in his late 70s honda. still hit me hard enough where i ended up bumping into the lady in the audi in front of me.

i was a witness for the court case because he wanted to fight the same kind of ticket as the op. he brought up conditions (some sand on the road from previous snow), his perfect driving record, even that his car's brakes aren't too great (which nearly backfired because the judge was close to adding defective vehicle), even tried to blame me that i stopped to soon and caused the accident. Well, under those same conditions, I was able to stop and not hit the lady in front of me. And so were all the others. the car behind the person who caused the accident didn't hit him. the judge was annoyed by him. He was the only one to get into a car accident on that street at that time. Told him that stuff like that happens, to accept it, and to move on.

Fine. Whatever. Take it to court. Remember, you have to prove to the judge that you were at a safe/reasonable distance. Hitting the car in front of you isn't exactly going to help prove your case. But you never know. If you get off, consider yourself lucky because it doesn't happen often. good luck.
 
Man, I'm sorry 🙁 these types of things just frustrate the heck outta me. Goodluck in court tomorrow. Hopefully you can get the charges dropped

In that situation i'd have stopped braking, geared down to second (in the situation you describe i'd be in at least third and engine braking hard anyway) and then either driven onto the verge or if the other lane was clear pulled into that to stop. I hope. 😉
 
Hit someone from behind....you're hooped! Unless you can provide witnesses, a long list of accident reports from that same stretch of road, and convince the Judge that the fault lies with somebody else. You're basically wasting your time trying.

Don't mean that as an insult or anything. It's just the way it is. Rear ending someone else is Guilty as Charged.
 
Five cars, including you, all had to stop suddenly, and you were the only person to hit someone? That's the issue you need to find a way to explain.
 
Here in PA if you hit someone in the rearend it's always your fault.
All you can do is say "Oops, sorry honey". 😀
 
Good luck. It's called "driving too fast for road conditions" or something like that. Basically they are going to tell you that it was your fault that you didn't allow yourself enough time to make a proper stop.

In your case I wouldn't agree with it, but it is going to awfully hard to convince a police officer or a judge otherwise.
 
I don't know that there is much you can do. At this point, I would get a lawyer, it seems like your best bet. Rear-ending someone is a tough situation, because in most places you (ther person who rear-ended the other) will get blamed nine times out of ten, even if you took all necessary precautions to endure safety. Just out of curiosity, what is the sentence for failing to stop?
 
Sorry, you don't know the limits of your vehicle in adverse conditions and don't change your driving habits accordingly, why would you plead not guilty?
