feels good that some ppl are empathizing. we've started the eviction process already, but it takes 60-90 days (that is what i was told).

well, you are legally bound to follow the eviction process, but there's nothing like good old fashioned changing the locks, padlocking the door, and moving his stuff out to the curb and 'accidentally' forgetting to send him notice.

Welcome to the life of a landlord. Everyone thinks it's so easy. All you do is sit at home and wait for the checks to arrive.

While this deadbeat is in your house, you're paying property tax, insurance, mortgage? and getting no income.

Baaaaad idea, at least in New York where I live. Doing that sort of thing will get any subsequent eviction order thrown out in most cases, and the police will have the right to enforce the tenant's ability to get back into the apartment, regardless of whether rent is paid up or not, plus a lawsuit can ensue.

Selling a tenant's possessions is also bad news, and just asking for a lawsuit for the value of the property. Once the eviction notice is posted and not responded to, the sheriff can come by and take possession of the items themselves, but you're not legally allowed to take possession of it yourself. Again, this is all in New York, but I imagine that at least the selling of property would be illegal in all states.

Sometimes, you gotta do what you gotta do.

yes you have to do what you have to do. long as it is within the law then fine. but changing locks etc is NOT within the law. in fact it will make the situation very bad for the OP.

sometimes the situation calls for being a man and throwing rocks at windows is not going to solve all the problems.

Wow..

We wer having some hard times a few years back and got the eviction notice 2 weeks after rent was due.

This goes beyond a lack of responsibility. This is an outright theft.

In addition to eviction you need to file a small claims suit for the rent they owe you. You'll win. They won't pay. Then you submit it to collections and make sure it shows up on all three credit reporting agencies.

You should also post a notice of inspection on the front door. In my state (and I think it works like this most other places) you have the right to enter after a you give 24 hours of notice. You can do this for any little excuse. Call it a lightbulb inspection if you want to. Say you need to install a new smoke detector. Whatever. You need to do this NOW so you can get inside and see if they have caused any damage to the unit. If they refuse you can have the Sherriff come with you and force compliance.

If there is excessive damage you may be able to win an injunction and have them removed immediately.

Our laws are heavily favored toward the property owners up here. Hope things work out for you.

well first there are places that will help him get a lawyer. heck he could even add the cost of a lawyer to the suit.

also many lawyers will take the case for a percentage of whatever they win for.

finding a lawyer is not a problem.

Can ya just change the locks? Or just put something in the lease that says if they do certain thigns ou can kick them out with 5 days notice in case it happens again.

And of course take them to court to get the case and court costs paid for by them too.
