So, last week I won an auction for THIS.

Pretty good deal from my perspective. Memory stick, nearly top-end PDA w/ BT and Wireless, and a case, for a little over 300 canadian.

I win it last wednesday, send PP immediately. I email the guy the next day to ask for some info, mainly "Have you sent it, and do you have a tracking number?" He responds, "I sent it yesterday." weird, but ok.

Fast forward to today. I get home from work, to find a package. I eagerly open it, to find not the x51 I was expecting, but a refurbished x50, inside a BADLY used case, with no stylus, dock, and a dead battery.

Do I have the right to demand a refund for this? I think I do.

That sucks. They have to have at least a feedback score of 100 for me to even consider buying from them.......
 
dont' buy stuff from people with feedback less than 100, and from buyers, not sellers. for ANY PRICE.

that guy has only sold one item before. you screwed yourself.

You can protest, but only because the model is different than advertised. You already knew it was used, so refurbished or not, you weren't cheated. The stylus, dock, and battery are not specifically listed, and he makes no claims as to the condition of the case.

I dunno. That PDA (the PDA, not the case) is far from "mint".

I generally don't buy from people using "stock photos" and I never sell things without specifying that the item shown in the pics is the item that's being sold.

The PDA is completely different than the one I paid for. I paid for an X51 mid, recieved a Refurbished X50 mid. Somewhat peeved off.
 
I would file the PayPal dispute right now and chances are you will get your money back.
I like sellers who provide actual pictures, but many times it is a reused picture or a stock picture.
