§9.41. Protection of one's own property.
(a) A person in lawful possession of land or tangible, movable property is justified in using force against another when and to the degree the actor reasonably believes the force is immediately necessary to prevent or terminate the other's trespass on the land or unlawful interference with the property.
In Texas a person has the right to defend property using any measure of force if the person believes that there is no alternatives. It doesn't matter if the person is threatened or not. It doesn't matter if the perps trespassing are involved in another crime or about to involved in another crime. It doesn't matter if they are threatening the person who owns the land or not.
Sub chapter D of the Texas penal code of authorized use of force details exactly what can and can't be used lawfully. Defending your own property to any degree of force is pretty much legal here. There is no such thing as castle doctrine in Texas as all land and property is defensible by the owner.

Actually from what someone posted earlier about Texas, it appears you have to be defending something. And by defending, that means there has to be threat of danger to that something. A person's presence by trespassing doesn't indicate a threat to the property. If their is a threat of damage to said property then you can defend it with violent force. Again, as I've stated in here before, if the way you state it is true then you'd be allowed to shoot a trick-or-treater who stepped on your land according to the law, which no state would allow.

No.... you just have to reasonably believe that there is no other way to defend property. And defense of property is stated as preventing trespassing, prevent re-entry, or expell trespassers specifically in subsection D. Everything else is superfluous. I specifically quoted the part in my other post detailing this.
So seriously, if you walk into someone's yard in Texas and they have a sign that state no trespassers.. you can legally be shot and the cops won't care. It has happened before and I know cops about this as well. I HAVE a bat shit crazy, red neck cousin do this to someone before out in Hondo. Someone walked onto his property, he pulled out his rifle and winged the person in the leg. The guy shot scrambled off the property and called the cops. Cops showed up, asked if the person came on the property. The guy admitted he did, and they cops said it was now a civil matter. Also told him good luck if he thought to win a suit against my cousin.
