Hey ppl
i have a question, If you are a 16 year old, and committed minor theft, apparently unintentional, max amount of items being less than $10, does that record ever go away ?
i mean its a very minor crime, and this person has no record of doing anything, and is a Honor roll student with a 4.75 GPA every semester, Cant you show these records to the judge to expunge or throw this case out ?
Thanks !

Depending upon your state, it can be difficult to get things expunged. Anything before age 18 will not show up on your Criminal History return. If you go for an indepth background check, they could retrieve the records from the local court where the offense occurred, but that it up to them to do so.

Yeah i will be doing that.
tonight i very shockingly found my sister disappearing at the local mall for like 2 hours until my dad got a call from the police saying that thay have her in custody.
She is the one person you COULDNT think could do anything like this, and a person who is excellent in school and everything, and my dad is VERY worried
about her record being messed up because of a small mistake like this, which apparently happend out of no where and was a DEEP shock to my family.

A lot of colleges ask for history of criminal record now, that might be the biggest problem.

MOST simple background checks won't find juvenile records once she turns 18, but many "in-depth" checks will still find them even with a state expungement. SOME records never actually go away, even though you may be told they do, however, they're not generally available to the general public.

Turning 18 should hide that good enough for most people, if she needs it completely gone I would see a lawyer as previously suggested.

Depends on the background check being conducted, for the vast majority of people it will not show up.

So guys any new suggestions, me and my dad talk about this every time, how we are just moved, shocked, and basically just awed that how the hell this type of stuff
could happen to us, i mean if you show the judge school records, ie. excellent report cards, and the like
he could overturn, and throw out this case right ?

i understand, i mean she got what she deserved, its fair, its a lesson
shes a smart girl, and i dont know how she could do something like this !
the stuff she stole couldnt even total up to $15, i had over $200 with me alone,
and i repeatedly told her tell me and ill get it for you.
Our family has never had any criminal history, we are honest people
and this is a SHOCK to us !

This is very true. Just because they say they are expunged, that doesn't mean they can't be found, whether you turn 18 or not.
Whatever happens, it's just petty larceny, which is a misdemeanor.

people steal for the thrill of it and maybe she is a kleptomaniac. and 4.75? are a's worth 5 in your part of the country? or has she been taking ap's since 9th grade?

btw ted kennedy goes to the store to steal a keychain with a beercap opener. thats why he steals said keychain. (sorry had to say it, get well soon teddy).

so are misdemeanors considered career threatening crimes ?
she wants to be a lawyer (ironic isnt it) she is Smart, has NEVER done anything like this before
and it sucks to see her go through this, and i mean whyd she do it, is what has gotten to me
this happend right before my 19th birthday, so it made everything worse.

while showing evidence of character is good at arguing for leniency, I'm not sure how convincing that is as far as trying to prove that the person didn't do what they are accused of doing (assuming that the case goes to trial and isn't plea-bargained, which the vast majority of cases are)....there's a number of criminals who were outwardly normal in behavior/action and yet who did shocking things (the man arrested for the BTK killings is a case in point).

that would be my guess, since i am not a lawyer

I think you should let her learn a lesson on her own and stop worrying about it. If she is really a good kid nothing bad will come of it.

oh no
i 100% agree on the lesson, thats exactly what she needs out of this !
im worried about my parents, i want to try find a way to help them cope with it, i am the oldest (19) and she is 16. She is the only sister i have,
and my dad (daddys little angel) trusts her with ANYTHING, my dad doesnt trust me compared to her, and to him it was a very very hard blow
finding his daughter in police custody, and doing such a harsh minor crime, which while having money, didnt pay for it and stole it.

better than her being a whore for the thrill of it. she stole for the thrill, got caught, will suffer consequences. she'll always be your daddy's little girl. btw answer my gpa question kiddo.
