Question on NON-Compete Agreements

tm37

Lifer
WHen I started my last job I had a NON-Compete agreement.

If memory serves I cannot quit and work with the same customers for 1 year.

If I am Fired I have 3 months.

What if I am "laid Off" with no Cause. It is my understanding that this would negate my non-compete. I have asked them to give me a copy of this agreement. I should have it tommorow.

Anyone know of the legalities of a Non-Compete in the state of MN.

Non-competes are rarely (if ever) enforceable in court. I wouldn't worry about it very much. Get the agreement you signed and run it by a lawyer.

Any idea how much that is going to cost me?

iirc, the only way they can be enforced is if you are specifically compensated, up front, in an amount you agree on, for the non-compete.

They are indirectly enforceable as when most are now out of work they cannot pay a lawyer and risk court costs and further legal bills. The company should have deeper pockets than any one employee.
