This is what happens when there is no wall between the politcal and judicial. Fortunately, our founding fathers understood this and is why we have a separation of powers. Unfortunately, even our SCOTUS has become filled with political activist justices as of late.

The time to stand up for Russian democracy was in fall 1993 when Yeltzin dissolved the legislature and shelled the Parliament building. At that time, the West had huge leverage over broke Russia, but Yeltzin got a free pass from his buddies in the West, leaving Russia with no counter-balance to a strong president, power that was further consolidated when he passed it on to Putin.

Exactly. Also let's face it is anyone disputing that he released classified information as a member of the armed services? That's illegal and he's subject to military law which is a lot harsher than civilian law.

He is still protected by the UCMJ which actually gives him greater rights to a speedy trial then civilians have. So far he has been imprisoned for 7+ months without being charged.

So who's disputing that he did what they say he did? Even his supporters just say he did it except they said he was justified. This is pretty straighforward jailing just like it would be in any country, unlike the Russian situation.

Me. He's not guilty until he gets his trial, and the government is violating his rights, even as a soldier by denying him that trial. At least in Russia you get a pretend trial.

He's going to get a trial. Even his lawyers expect a trial in Spring 2011. It's really pathetic when people act like we're similar or worse-off than Russia. Just because you understand that due process takes time doesn't mean there's no due process.

His lawyers have called his conditions torture and have requested the UN to investigate. So, yes he'll get a trial after the government holds in solitary confinement for over a year without charging him, violates his right to a quick trial, and tries to force him into a confession.

As far as this country being better or worse than Russia, I don't see anything to brag about write now. We are kidnapping people of the street and sending them to torture centers in countries throughout the world that we run. The government is now spying on everyone, encouraging people to report on each other for suscipous behavior, while our lawmakers try and change the law to allow the government to hold people without trial (like in this case).
