PSA: Some companies are indeed out to steal your drive

I had a busted hard drive in the winter of 2021. I sent it Disk Doctors, gave them the invoice. But they've managed to drag their feet and not even bother to charge the credit card I gave them for recovery. Waited months, called them on June 20, 2022, and they stated they would email me the file list. Didn't happen. So I emailed and called them today, demanding mere return of the drive. Even today, the motherfucker stated he was "just taking calls". I pressed further, saying that he can charge the credit card on file. So, he least made appear that he looked at my case number and "assured" me they would send out the drive.

Given they've dropped the ball every time in the past, assurances are bullshit with this company and its principal owner, Leo Lionhart. So yeah, it's time bring America's favorite popgun: The courts. Replevin is the action I'm trying to do, and there is already a stumbling-block. The drive is freaking Georgia, and I'm in Maryland. So I have to figure whether I can file in my home state(they do have a forfeited business but knowing their bullshit, they might just simply avoid service) or have to do stuff long distance with an attorney in Georgia.

I have suspicions they want to keep the disk for themselves, because the drive is an enterprise grade drive, a WD Gold.

Even if I do get the drive back, there's no telling if it truly the original with my files or they swapped in some other dude's brick when I do get it back or if the intentionally toss some sand in there to make sure the next guy can't get shit.
 
There is a concept called backup your data before SHTF.

It can be done weekly, daily, or in real time depending on how critical the data is.

Yes, that would avoid the issue.

I am operating on a shoestring budget and my hot temper got the better of me. I threw headphones onto an external enclosure and that's why I'm in deep shit now.

Even so, that doesn't that some piece of shit should taking my drive hostage and not promptly giving it back if they can't do anything. I got evidence of freaking criminal activity on that damn drive.

My own competence does render me complacent, slothful, lazy. Just like I didn't bother with supplements during my wisdom teeth extraction recovery but when my sister had to deal with it, then I'm telling her to swallow vitamin C, Zinc, L-arginine, cod liver oil to speed up the healing(hopefully)

I believe the term you were looking for here was "overconfidence". 😉

I've never heard of Disk Doctors but they appear to have positive reviews. (mainly from pre-pandemic) OTOH I've used Drive-Savers personally a bunch of times for clients and friends with great success. They're not cheap but they are 100% legit and honest.

I would start with a few scathing 1-star reviews (don't lie in them!) and then if they don't take care of you proceed as mentioned with small-claims court.

Although to be fair simply MENTIONING ethnicity isn't the issue so much, it's the obvious negative connotation that's a problem for me.

This is about the 5th time he's done this sort of thing too... pretty obvious where his head is at.
 
I'm confused - what are you going to sue them for? They haven't charged you, therefore there is no contractual obligation. Theft of item? I seriously doubt anyone gives a shit about a couple hundred dollar component.

Just draft a serious sounding legal letter and send it to them certified mail. Bet you get your drive back in less than a week.

Actually I'm pretty sure small-claims court would take this case provided OP can prove he (a) owns the drive and (b) left it with the business expecting a diagnosis/data-recovery.

I also agree that sending the certified letter stating that OP wants the drive back prior to taking legal action might work and is certainly worth a try. (plus might prove helpful to show you made a "good-faith" effort to resolve things if you ultimately do end up in court later)

It's pointed out so people don't get the idea that it's hillbillies with guns and spitting tobacco running this operation...or hood rats deep in Atlanta. Because the former is the first thing people think of when it comes to Georgia and the latter is the second. The reality is all humans can be duplicitous, but the style sometimes differs amongst races and ethnicities. Some cultures train their children better than others to exploit systems of rewards and punishments. And in America, transgressions are not automatically nipped in the bud. The victim must pay to remove the transgression. In my case, that will be the cost of hiring an out of state attorney to file a replevin case to retrieve the drive. Keep delaying until the statute of limitations passes, and boom, free server grade hard drive. The Arabs I came across uses tactics of "nope, do not have relevant assets for a financial check, but let interest you in diamonds or something from my business, that can sucker most legally unsavvy who don't realize those assets cannot be sue for successfully).

If it was racism, it'd Hindu voice, I'm not even giving my money to them. But I did consent to the contract, gave them my credit card info, gave them more than the 12 business days listed in the contract. Did not haggle them. (Contacted them less than a month). For urgency I want to have this data recovered...I was soft as chinchilla in deamdning them to actually get the job done or send it back timely.

I've spent the entire day looking up lawyers, calling the local court to determine which jurisdiction the replevin is supposed to be filed if it goes that far. Submitted a complaint to the GA attorney general...but 6-8 weeks is far too slow.

Then I have to file a tort in MD court because I doubt I would get attorneys fees from the replevin action alone. And I plan to drop a line to the Comptroller, letting them know that the company should file their paperwork to continue doing business in MD(not like the state would punish a first time offender with the max misdemeanor penalty of $500).

Replevin. Usually for businesses doing business things. It may theft morally but not a violation of criminal code.

The following is where I got the understanding that keeping inventory of stuff is incredible important for property. GIven that the case went to the MD Court of Special Appeals, that means both sides were ready for war and really wanted to win. Since this was on the Eastern Shore, good thing the internet exists....
