What they will do is order the owner to trim his tree then if he doesn't comply, they will send someone out to do it and bill him for the job. If he doesn't pay they will put it as a lien against his home.
The first thing to do is to talk to him though and let him know it's causing a problem for you.

Interesting question. Just a guesshere but since the tree is not your property you shouldn't be able to, unless some local ordinance lets you do it.
Is there a reason you want to prune it? Is it a nuisance to you? Because that might get you somewhere. Why not just talk to the neighbor.
