Property question

If there is a tree on my neighbor's property but it extends over and it's branches and leaves cover over some of my property, am I allowed to prune it? The tree is pretty high, 40 feet or so so the branches extend out pretty far.
 
Interesting question. Just a guesshere but since the tree is not your property you shouldn't be able to, unless some local ordinance lets you do it.

Is there a reason you want to prune it? Is it a nuisance to you? Because that might get you somewhere. Why not just talk to the neighbor.
 
Just call the county/city agency that handles the issue and have them do it.

What they will do is order the owner to trim his tree then if he doesn't comply, they will send someone out to do it and bill him for the job. If he doesn't pay they will put it as a lien against his home.

The first thing to do is to talk to him though and let him know it's causing a problem for you.

I've just finished doing renovation work on my new house and now starting to take a look at the exterior. Our backyard is really patchy because shade from the neighboring trees doesn't allow enough sunlight to fall on the grass. There's a complex next to my house with a huge tree that gives alot of shade. I've got a tree on my property that I'll probably prune to help out too. Since it's an condo complex next to mine, I was wondering if they might not notice me cutting a bit of their branches 🙂

BTW: The branches extend out into my property.
 
IAMNAL, but it seems pretty irrelvant that the branches extend onto your property. The tree belongs to them not you and you don't have full rights to the skys above your land.

See if there is a local law that lets you prune maybe.
