Sounds like a trespass on chattels. It is a property tort. Maybe I just don't get the question.

we didnt' do chattels.

it was like... "how do you stop spam? discuss property rules with relation to spam."

i think being a computer guy was a liability, because, though i talked about methods to stop spam, i didn't say much about property other than spammers being the lowest cost avoider... which isn't something specific to property.

I remember half of my property exam was on the rule against perpetuities (which is being phased out anyway). I was ready to shoot myself when it was over. Luckily I escaped with a B

Yep, that sounds about right. We never covered it in property though, I learned about cybertrespass in IP Unfair Competition.

the RAP question didn't say what RAP was applied... so i was like... classic says this and dude is F-ed... the 'wait and see' says this and dude is golden... the USRAP says this so dude is F-ed... the cy pres (Texas) says this so dude is golden... other places have gotten rid of it so dude is golden... the AP doesn't run against him because he is a future interest... blah blha blah more beer!

USRAP for newbs: if every alive right now were to die and a child is born would that child get the interest or die trying before turning 21?

All I remember about my property final is that the prof spent half the semester on future interests, and 5 minutes on an earnest money contract... guess what half of the final was on.

I as happy to get my C... lets just leave it at that 🙂

Life or life in being plus 21 years...

RAP.

That is all you need to know for the Bar. 🙂 Let it ooze out of your brain. You should not see it again, unless you are going to take Wills and Trusts (Great class, BTW - take Buchanan... he rules.)

That is a terrible loss. I was going to recommend that you take Trusts and Wills and First Amendment from him. He rules!

The last question on my Civ Pro final Thursday was so convoluted I still couldn't tell you what the question was asking. Had a bizarre quote from the 5th Circuit that we were supposed to evaulate in light of the twin aims of Erie as discussed in Hanna. My answer basically consisted of random words I picked out form my outline that seemed to have some correlation to that subject. We spent at least 10% of the semester on Erie/Hanna/Direct Collision and this is the damn question we get?

I've got property Monday, not telling what weird-ass shiat will be on there. She always asks a "sci-fi" question, something about "Imagine a word without (zoning, private property, easements, etc), what would this would look like?" Can't wait - closed book, should be a major pain in the ass.
