Seems like you've tried the nice and reasonable, even generous approach; sounds like legal may be the only reasonable way to proceed now.

Best of luck, I know how annoyingly loud some of these units can get. Unfortunately, they can run for years in loud mode before finally giving up the ghost.

I was holding off litigation until the last resort because it's quite costly (even through my hook ups)

Your choices now are live with it, vandalize it, or pursue litigation. They all suck, but only one of them is going to solve the problem.

It may sound a little insensitive, but IMO if noise bothers you then you shouldn't be living in a connected living space. Apartments, condos, etc will all have noise associated with it and it's part of sharing walls/floors/ceilings with other people. If you can't sleep with noise you should look into renting a house.

No offense taken but I think you have very narrow outlook. You can very easily be confronted with a unreasonable amount of noise when living in a house as well. That's why there are noise laws and code enforcement divisions that enforce them (including the cops). There are people who specifically practice nuisance and trespass law and their practices are not limited to apartments and condos. If I go with the rationale that if people are bothered by noise, they shouldn't be living in a connected living space, I can easily turn up my logitech speakers, crank the bass, put the satellites on the floor, and leave to run my errands because my downstairs neighbor shouldnt be bothered by noise.

On days when he's turning his HVAC unit on and off, turn a fan on high for white noise. You said it is only the turning off and on that bothers you, and the non-stop fan noise should hide that.

A lightning strike could easily ruin his HVAC. That's clue #1. If you need another clue you're hopeless.

Legally, I can do this, and it would be easy to do as there is open access to the roof and there is power switch right beside his HVAC unit but it's a temporary fix as he can just flip the power on.
Keep doing it along with a note, it will drive him nuts, especially if it's at irritating times like when he's just laid down to go to sleep.

We need MSPaint drawings to understand what type of HVAC unit you are talking about and how it is directly below your bedroom.
Wouldn't that make it directly beside his bedroom?

Is it a bank of AC Condensers? (2, 3, 4?) Is it a window AC unit?

My neighbors are dicks, and the guy that lives at the entrance to my private road driveway (four of us own it, easements are involved.) is the building foreman. I guess they aren't selling as fast as they word, so they are leasing the next four that were just completed to the builders. Now all of these asswipes surround the entrance to my private road.

I showed the city planning dept. how messed up my road is and he laughed at how bad it was, asked me what I wanted to do. So, He's going to paint all the curbs red near the entrance and make it a fire lane.

Now if I can figure out a way (I live at the very end, no easements on my property.) to keep everybody off my property, I'll believe it when it happens though. And the fucking dog that keeps shitting in my yard, loiuiopujannklavnnkj;qgi;hhjkladfs!!!!! I honestly don't know wtf is wrong with people these days. It's called common decency folks.

I complain about noise (like the landscapers and airplanes flying overhead every few minutes) but you're in a building shared with many others. Gotta live with it. Other than that, play music with lots of bass so you can share your agony with him.

Try your city, a lot of them offer free mediation (usually sponsored by the municipal court) as a step before filing in small claims. Maybe that will get a response from the owner.
Though if you go this route you may have to be willing to get an estimate from a HVAC tech that the condenser unit is actually malfunctioning or in need of some sort of maintenance.
