Problem with neighbor: would would ATOT do?

So I'll try to make this as short as possible. I live on the last floor of a 3 floor condo complex...the neighbor directly below me has a HVAC unit directly on top of my bedroom that sounds like an engine every time it turns on.

The problem is he rents the unit from the owner. When I first moved in, I tried knocking on his door to talk to him about it but he would never answer. So I left a few letters on his door. I contacted the HOA and they were useless (surprise surprise) because they said this was a "private" dispute (although HVAC units that are not properly maintained are a violation of the CC&R).

I asked them for the contact info of the owner of the unit. They gave me the address but several letters came back as undeliverable. I advised the HOA that they got the wrong/out dated address for the owner but the rep from the management company tells me that I'm sending the letter wrong :roll;

Anyway, I tracked down the address using my own sources. However, I'm pretty sure the owner got the letter from the tenant anyway. The tenant went months without even using the HVAC unit (I told him in the letter that I don't even mind the noise as long as it doesn't turn on and off literally dozens of time per night when it's the loudest). However, in the last week or so, it's been the same turning on and off dozens of times during the evening.

What does ATOT recommend? I'm almost to the point where I think I should take legal action to get their attention.


2 Month Update:

I called the HOA and asked for the contact info of the owner one last time so I can have my attorney send a letter over. I found out that the unit was recently purchased and re-rented. Of course they couldn't give me the phone number of the new owner, just mailing address. I was able to find his # through my own due diligence. I called him up and he answered...very responsive. Sounds like a nice enough guy.

Anyway, I explained the problem to him. He told me the old owner was on the verge on bankruptcy and his tenant was a drug dealer who didn't pay his rent every other month, which would explain why he was ignoring my letters. Anyway, we talking about the situation and I offered to pay half the repair costs (even though I have absolutely no obligation to do so). I got my A/C guy out to my placed today and he was able to relocate the unit to sit on top of the bathroom instead of the bathroom. He also covered the compressor with a vibration jacket and put the actual unit on vibration pads. The difference is night and day. The sound to the rooms is nearly inaudible. Problem solved thanks to responsible owners.

HOA does nothing to help.

Get a large trash can, fill it with water, and lean it up against his front door.

Legally, I can do this, and it would be easy to do as there is open access to the roof and there is power switch right beside his HVAC unit but it's a temporary fix as he can just flip the power on.

Make a homemade EMP generator. They cost $500+ to build, but that fuckin' HVAC unit will never work again without extensive repairs.

Offer to pay to have it repaired...lets cut to the chase this is the only thing u can really do...how loud could it possibly be?

I have offered to pay for half, without a response. That isn't the only thing I could do...I can sue the property owner and request an injunction. If the problem isn't abated, it can be referred to the city attorney as a criminal complaint.

Sorry man...i had to deal with a shitty neighbor with a loud subwoofer right above my bed. Sucks big time. Hopefully it gets resolved, i feel your pain lol. I HATE being disrupted while im sleeping.

If it's a heat pump let all the freon out of the unit. A service call will be needed and maybe the tech will fix whatever is causing the loud noise too. It's illegal to discharge freon so don't get caught.

Then do that. And petition the HOA to fine the owner for failing to maintain the HVAC unit.

You've exhausted all the "friendly" remedies, now it's time to go over his head.

The HOA refuses to even arrange a sit down with the unit owner so we can discuss possible solutions...

I was holding off litigation until the last resort because it's quite costly (even through my hook ups)
