Problem with ebay user, what would you do?

I had a scanner up for auction and my listing clearly said shipped to US only. This guy from Europe bids at the last minute and wins. I tell him I will only ship it if he pays the extra shipping which was around $40 total. He says no so I am forced to file a non paying bidder. I tell him that I am going to lose about $10 if I don't. He says fine and I don't hear from him for a week.

I wait the 10 days before I can request the final value fee credit and I still hear nothing so I send in the request to get the credit. I get an email about 8 hours later saying he sent me the money for the listing fee and is asking me to cancel the credit request. He says the money will be hear shortly. I said that when I get the money I will cancel the request. He sends me another email saying that I should trust him and the money is one the way and asks me agian to cancel the request. I noticed ebay has suspended his account, so this must not be the first time he has done something like this because ebay has a three strikes rule before they suspend you.

Should I cancel the final value fee request before I get the money from him or wait till I get the money? He has a record of about 95 positives, 3 neutrals and 1 negative.

I would wait to see how much he sent to you before cancelling the final value fee request.

I wouldn't trust someone from overseas, hell I would have hard time trusting any strangers for that matter.

Yeah, he could say he is a trustworthy, but how do you know for certain.

What is his hurry? He could wait few days.

I recently bought a hard drive from one of the Anandtech member, I sent him money
and I didn't expect him to send me the hard drive until he received the money.

Well, in situtions like that I file the nonpaying bidder alert, and for the reason, I put that both parties mutually decided not to complete the transaction. It immediately gives you the credit for the final value fee and doesn't put a ding on the buyers account either....for me it is just easier.....

I would have then just relisted the item. From my experience, I don't even try to "force" them into paying, I simply relist. If somebody hasn't either paid me the money or I am reasonably certain that the money is on the way within 7 days, I relist the item.

I won't do anything about pulling the credit request until I get his money. He thinks I am being unreasonable, but he didn't contact me for 10 days after I told him I was filing for a non paying bidder which was 7 days after the auction ended. It took me 18 days after the auction was over to get my money back from ebay and he thinks I am being unreasonable.

This is a no-brainer. Do not give in to this guy. He did not give two sh_ts about you when you told him it would be extra money to ship outside the US. On top of that you stated your auction specified US only. And then he waits until after the 10 day period to try and fix it. It smells like "No good deed goes unpunished" with this guy.

This was the first time I ever had to file a non bidder alert. He never said that he would pay me the $10 I owed ebay until I requested the final value fee credit. That was 17 days after the action ended and I hadn't heard from him in 10 days. I had to relist and the auction ends next week. I should of had the money in my hands already and not have to worry about this. It took a week for him just to tell me he wouldn't pay the extra shipping.

Well, like I said, if you file the Non-paying bidder alert and put "that both parties decided not to complete", you instantly get your final value fee back without having to wait, and the buyer also won't come back and either bitch or file a negative feedback on you.....just easier imho. In this suituation I would wait until you actually see the money though, because I will bet lots of money he is blowing smoke. It takes three strikes before they close your account, so obviously he has had problems with other auctions.....

Proceed with the final value credit. He is in clear violation of ebay rules and to have ebay suspend him shows a top 1% of the problem users. If he sends the money, pocket it. You never asked for the money in the first place, so by postal laws, the money is yours to keep.

Since when does ebay have a 3 strikes rule? They suspended my account without attempting to contact me to resolve the issue, they simply took the other partie's word for it.

Keep the FVF credit request and push forward with selling it anew. eBay can suspend your account for a single infraction, including bad email address (Their WBN's getting bounced) or failure to pay fees due.

eBay's policy for non-paying buyers is:
First offense: warning
Second offense: warning
Third offense: indefinite suspension
