Problem with eBay Purchase

Using the live.com cashback eBay promotion, I picked-up a digital camera. The camera was listed in the auction description as 'New, Never Opened.'

Going thru a more detailed description of the item, it lists:
Item Condition
* Overall: BRAND NEW
* Packaging: Item In Original Packaging, Which Has Been Opened & Contents Verified

Alright, based on the price and the fact that the seller has an eBay feedback of 27503 with a feedback score 99.1% Positive, I decided to go thru with the purchase.

I got the camera today. The package was opened and everything appeared in new condition. However, I did notice a Bestbuy sticker inside of the box. Now, I turn it on and find that there have been pics already taken and in memory. The pics are from the inside of a Best Buy store. I got sold a store demo model.

What should I do?

Ask for a refund? Brand new replacement? Partial cash back? Or something else?
 
Well, I'd ask for a new one at that point, that is shitty for sure. Given the large amount of feedback, he probably bought it at an auction lot somewhere and was lied to himself. Despite that, he should have verified and is in the wrong, so to keep it simple, if it is in good condition, I'd ask for 10% back or something through refund.

 
I'd ask for partial refund. The seller almost certainly violated eBay terms of service, and he's clearly in the wrong. If you don't get a partial refund, definitely leave negative feedback, warning people that he's selling "floor models" as new.
 
Thanks for the feedback folks! He does offer a full money-back guarantee but I would probably be happy with a partial refund.

I sent the seller an email about the issue and asked 'Before leaving eBay feedback, please let me know how you want to handle this.'

We'll see what happens.
 
Woot! The reseller just got back to me and offered a $75 refund (33% refund) and add the 40% live.com cashback, I got the camera for $50.

fwiw - It was a Panasonic Lumix TZ5.
 
Sounds like what I expected, he purchased the item in a lot of goods from a liquidation sale, was sold to him as new in box, so he sold it that way.

Glad to hear an honest guy is still on Ebay.

Your cashback *may* be in jeopardy by him issuing that refund. I have had one cashback voided by a 10% refund on a purchase... Just FYI.

Well, if that happens, the refund was greater than the cashback anyways. The cashback was actually 30% but I included a 10% eBay coupon(to get the 40% listed above) which I've already received the money on.

How the hell did you get 40% live.com cashback? I thought the highest was 30%.

cool - but be careful, if you get refunds live.com might void your cashback

and the TZ5 is nice, there's a relatively easy way to convert the 1280x720 videos to ps3 compatibility (no reencoding!)
