Problem with AOpen 56k modem

I have a AOpen FM56-PM fax modem. I believe this is a software modem. It runs ok, but I can only connect at 48k max. Is there a setting or something I need to switch???
Also, the modem randomly disconnects my internet connection. This is very annoying, especially in the middle of a download. Any ideas to resolve this???
I didn't have this problem with my old system which had a 56k ISA hardware modem. I don't have any ISA slots in my new system.
Also, is there anyway to turn off the annoying squelch sound while it first dials in. My old ISA modem had some jumpers which allowed me to turn that off. This PCI modem has nothing which I know of.

Thanks.
