Problem on ebay!

I am the buyer of this.

I saw the picture of the box and assumed that it was a US version in the box since it was listed as new.

I received a DVD in a plastic sleeve with German written on it.

He says that I did not ask if it came with a box!

I offered to give him positive feedback if he refunded the shipping fee. He has not responded.

What would you do?

Does the game work to your satisfaction? Do you really need a 3 cent box? If so, leave neg. feedback. Just remember, sellers usually retalliate.

Your point is taken. No, I do not need the box.

My problem is that I could have bought exactly what I wanted for $19.99 from Circuit City.
He also asked me to pay him an extra 1$ for his paypal fee if I wanted to use paypal. And I did. So, I paid $11.24. It bothers me that I could have got exactly what I wanted for only $9 more. But, I did not because I was misled by an advertising that seems to be intentionally incorrect!

It is the principle that bothers me. He may be doing this to everybody. Why?

Leave neutral feedback, you've hopefully learned your lesson, now just move on. Next time understand that nothing is guaranteed when a stock image is displayed.

If you really want the box, buy the game from Circuit City then sell the disc to Gamestop or EB Games.

And if you look at the guy's feedback history, he has not left retalitory feedback for others who game him a negative. People get too worked up over retalitory feedback, but really it's just a shot to badmouth eBay. I've rarely rarely seen sellers who do that, and the few that do are the ones selling shoddy products, so you wouldn't want to bid on their items anyways.

I would say just suck it up.. I can understand being a little agitated. Its kindof a grey situation, on one hand he shows the box in the pics, on the other he lists " (GAME ONLY) " in the features.

If it were me I would just skip leaving feedback at all

if i were to leave feedback, i'd leave something neutral, maybe like prompt delivery but contents slightly inaccurate.

There. That bolded bit. That means you get the game only, not the box. You didn't read the description properly, you're (technically) in the wrong. The seller is fine.

I would leave a neutral, and leave it at that. However make sure he leaves you a Positive first for prompt payment and complying with his request for extra fees.

I see the "Game only" bit now. You are right; I missed that little bit. I wonder why the picture of the box is so big and the "Game only" bit is so small (in comparison) and listed under the game features!

He was also charging $5.99 for shipping, which further led me to believe that it was a box. Why would someone charge $5.99 for shipping a DVD in an envelope?

To be fair, I have to mention that he has offered a refund if I return. But, he has not replied if he will give me a full refund. I suspect that he will only refund the $4.25 bit, which will leave me out of pocket for $6.99.

If I sell something like this, I will right in bold that it does not include the box and manual. I cannot see how this has been an accident. It looks to me that he counted on this! Charging extra for shipping guarantees him that he will make $5.99 even if there is a return. This is wrong in my book and I have given him a negative feedback. Not because of not including the box. But, because of the big difference between what is clearly advertised and what is really being sold.

For someone with over 1000 items sold, this cannot be an accident. He could have clearly shown what he was selling. He did not!

Yes, but he'll get away with warning, unless he's a multiple offender.

Well, you get what you pay for. You should have asked questions if you weren't sure. ebay seller always charge a lot for shipping because of ebay/Paypal fees. Not the best seller in my book, but it's ebay!

After I left him factual negative feedback, he left me personal negative feedback.
I filed a complaint with paypal as well.

He then contacted me and asked to resolve it.
I proposed again, as I had before, that he refund shipping and I would withdraw my complaints.
He claimed that he was not making anything and proposed to pay only $3.00.

I accepted.

He offered to pay it to my paypal account.

I gave him a taste of his own medicine. I told him to send me a check for $3.00 or send $1.00 extra to my paypal account. He knew what I was getting at since he asked me the exact same thing when I wanted to pay for the game.
He said that he would send a check "but please withdraw the complaints immediately". I said I would as soon as the payment was cleared. He sent $4.00 to my paypal.

I withdrew my ebay feedback and paypal complaint.

I would not have bought it if I knew it was only a DVD. But, I wanted to resolve this. I was not going to ship it back for a partial refund. I am happy with the final outcome.
He should be too.

He claims that this is his business.
I hope that he is clear in his future postings. I for sure will be much more inquisitive if I ever want to buy on ebay again.

Actually the "Game only" text could refer to Bullet items immediately following it. He should have a notes section stating that the box is not actually included because he DOES show the box in the auction. He was in the wrong but at least made it "right" for you. It is hard to complain about getting a game for $13 less than retail. What would you have done besides recycle the box anyway?

When I buy a new game, I always keep everything.
After I play it, if I know that I am not going to play it again, I will sell it on ebay. It helps then if you have the box and the manual.

That works. I usually keep the boxes also incase I want to resell the game.

Yes, you are right.
But, that is not what I was complaining about. I complained about his not being clear about what he was selling. No matter how good the price is for something, it can be useless to you if you don't want/need it.

I expect a good seller to tell me exactly what it is that he is selling and let me choose to buy it. I don't appreciate it if someone lies to me and makes me pay for something and when I complain tell me "but it is a good price". Yes, it is a good price. But, it is not what I paid for!
