price tag on product refuted by EB Games clerk

I will try to make this as cliff notes as possible

- go into eb games looking for used Guitar Hero 3 for PS2
- find one with a price tag of $39.99
- take it to clerk, ask him if, "it is a decent deal for $39.99", he doesn't seem to really have a clue so i decide i want to buy it. he says, "the lowest price you can find on a used game over there is what we will charge for that game"

So there are 'used' 3 Guitar Hero boxes. One has a price of $59, one $54 and the other the aforementioned $39. Only I like the condition of the $59 box better so I go back and grab it and bring it up (losing my spot in line btw).

The dude rings it up and says, "that'll be $62.17" :confused:

I say, "Oh it was supposed to be $39, you said the lowest price I could find was the one I would pay... do you want me to get that box again?" He says yes, so I go get the box with the $39 price tag.

He takes a close look at the tag and says, "oh, this is a price tag for Guitar Hero 1..." and points to some miniscule print at the top of the tag that was hardly even legible.

At that point I said $62 was way too much and decided any further action would be best left subdued for the moment because I was about to snap. I got my CC back and left the store.

my SO and she says that they have to honour the price on the tag no matter what.

My question is, even though $39 might have been a bit much for a used game for an aging system, should the guy have honoured the price?

As a side note question, why do EB games clerks have so much attitude? Did I do something to them I'm not aware of? I'm going to email EB Games and tell them their place sucks ass. They lost my business! dicks

UPDATE: I found a used GH3 with a wireless guitar for $60 on Kijiji and I'm picking it up after work. w00t the guy lives right near my office. WIN

Uh, i think it just makes sense that different used copies of a game have different resale prices depending on condition... isn't that always the case?

No, that's just the justification, as any retail worker can tell you.

Now if the price on the shelf is different then the price you're scanned, that's a different story.

Calm down, sheesh.

You were just offered a logical (and reasonable) explanation as to why stores don't generally honor wrong price tags.

Nobody tried to "dick you around" either. It was an honest mistake, I'd be willing to bet. And, it really caused you very little hassle.

Why would it be $59.99 for a used copy for PS2? GH3 is $34.99 used for PS3 at my local Gamestop.

I think some states may have laws that require them to honor a price mistake on the price tag, but I think that's stupid personally. That's fine for a grocery store where you buy dozens of low priced items and it would put an undue burden on the customer to verify the price of every item. But in an electronics store where a price mistake could be a significant amount of money, and you would obviously recognize the mistake before purchasing and would have the opportunity to decide whether you want to buy it, it just doesn't make sense to force the store to honor a mistake. It was a mistake, and it was caught, no harm, no foul.

Depends on your state's false advertising laws. IIRC in Texas, the lowest visible price is what must be honored. There are of course some exceptions like if you submitted an ad for X item for $1000 and the printer screwed it up and printed X item for $100, that's not the sellers fault and they don't have to honor the price. However, if the seller mislabeled the item, they must honor the price.

YMMV.

I thought they only sold the used games and guitars separately.

I think the OP is in Canada; despite the change in exchange rate, video game prices don't really change mid-generation, and the used prices are based on the new prices... so there you go.

$34.99 for GH3 on PS3 sounds atypical for EB/GS... Guitar Hero 2 for PS2 goes for that much.

But if the label has the item's name on it, can that policy still hold true? All GameStop labels for used games, at least as far as I remember, have the title at the top of the sticker, above the UPC.

Mis-labeled prices, sure... but an entirely wrong label that clearly states it is for something else? And a UPC to match? At least... I thought I remember their being UPC's on the used stickers. Might be wrong, but I do remember seeing the titles on them... it's that way with new games at least. Haven't bought used in awhile, mostly because I pick up games when they are brand new and used doesn't even exist or are priced so close to the new price might as well pick it up new.

Move on. I could see if you wanted to push for the $54 price tag, but the 39 was obviously for a different game. Don't be a dbag.

EDIT: Your GF shouldn't be one either, since she agreed with you.

Even though I hate EB/gamestop, I'm glad you didn't rip them off. Hmm, this xbox 360 has a "cabelas big game hunter 5" for 9.99 tag on it. I'll just bring this to the register and then complain when they refuse to sell it to me for 9.99 even though there is a tag!

EB Games DO exist outside of malls, btw. ;)
None of the Gamestops/EB Games/Funcolands in Toledo were in malls... a Babbages was in the mall (is, now its GameStop), and all are now known as GameStop since they now own the entire freaking game store industry it seems.

I just call it like I see it. PS3 and Wii were $34.99, while 360 was $39.99. I questioned the clerk about this and he said it was because the 360 version was the most popular and this warranted a higher price.
