here's the jizz..he is afraid that since the child is only 2-3yrs old the mother may get sole custody which will defeat the purpose of this entire thing and he will lose the kid forever. i dunno much except from watching tv and it seems small kids are often given to mothers?

I know exactly what he's going through. He hopes he can salvage the situation, and doesn't want to escalate things. But he needs to protect himself NOW. If she leaves with the kid, things are going to get extremely difficult & expensive, with no guarentee of the outcome.

If he wants to make it certain, he could call the state dept and cancel the passport. She won't know until she gets to the airport and gets stopped. If the situation blows over, throw the passport away (claim to just not be able to find it), and get him a new passport.

This involves keeping a secret from the wayward wife, but it won't come out unless she tries to skip the country with the child- and it'd be quite embarassing to try to flee with the child and find out at the airport that she's flying alone if at all.

If he has *proof* that the mother is trying to kidnap the child before getting sole custody, I can't imagine a court giving the child to her. This proof would have to stand in court. If they are at this point, divorce is going to happen anyways, file now.

If he (and the lawyer) think it's enought to get him custody, I would go that route. Regardless of the visa situation, what she is trying to do would be considered kidnapping if she was successful, right? If so, he has evidence the mother is trying to commit a crime against the child, no court in their right mind would turn custody over to her. Then again, I'm sure his sh!t stinks too, all this will be aired out in court. If he's a reasonable stable parent, I would think that's his best bet.

The e-mails had better be specific, not "do you think we could do this?" but more like "the visa has been arranged, the tickets are purchased..." It had better show more than intent, and couldn't be turned into "I was just making plans to travel with my child, and the husband didn't know, yet."
