Prassi vs. Adaptec war continues

"...Adapte and Roxio today announced that the United States District Court for the Northern District of California has again awarded monetary sanctions against Prassi Software USA Inc. ("Prassi&quot😉 in the ongoing lawsuit between Adaptec and Prassi concerning Prassi's copyright infringement, trade secret misappropriation and breaches of contract. This, most recent, award of monetary sanctions follows the United States District Court's Order finding Prassi in contempt of court for violations of the preliminary injunction and awarding the amount of $160,000 to Adaptec, Inc. for such violations.

The most recent sanctions award arises from Prassi's violations of prior discovery orders and what the court characterized as "obstructive conduct". On this occasion, Magistrate Judge Edward A. Infante awarded Adaptec $33,896.31 as monetary sanctions "to deter defendants from such obstructive conduct in the future."

In response to this sanctions award, Dana Miles, the Vice President and General Counsel of Adaptec stated, "This latest award, just like the earlier determination that the defendants were in contempt of the preliminary injunction, confirms both the court's and Adaptec's intention to require compliance with the law and to seek all appropriate remedies for Prassi's misconduct. Adaptec will continue to vigorously protect its intellectual property and to seek all appropriate remedies from Prassi for that conduct." Adaptec's action against Prassi Software USA Inc. and its principals is pending in the United States District Court for the Northern District of California before District Judge Jeremy Fogel. No trial date has been set..."
