Actually Probably not unless her attorney's get a hearing on the bail question.
Personally I think the Judge decided to do this since this is the only way to get her in Jail for a subtantial amount of time. If he would have sentenced her to 30-days she probably would have been out in 5-days because of jail overcrowding. Because she is a non-violent offender the LA Sheriff would release her after only serving part of the sentence.
By holding her with a no-bail option until the next hearing on October 22nd he has essentially sentenced her to about 30-days and she will probably serve the 30-days. She doesn't have a sentence she is being held for a hearing with no bail so there is no getting out early. Unless the LA Sheriff decides to release her to home confiment or her lawyer somehow gets another hearing on the bail question. Releasing her to home confinment would probably setup a fight between the judge and LASD, remember Paris Hilton fiasco. So basically she will probably be back in court on 10/22 and he will then sentence her to time served since by that time she would have been in jail for almost 30-days.
Kind of back door way to insure that she actually serves most of a 30-day jail sentence but effective.

She got cut a deal and released early. Violated almost immediately the terms of her early release and then was shocked when he locked her up again. She can't be this retarded can she?

It's shocking because the underlying offense is a misdemeanor, and people connected with the case were telling us the judge had to offer Lindsay bail.
