Kick ass......this is pretty cool....I Ordered one Origionally and didnt get it like everyone else though i didnt bitch and moan etc but this is cool.

You know, it's funny. I've recieved three free monitors and other free stuff from online venders because they screwed up. But, if you make real nice to them when they screw up, get to know them on a first name basis, they'll take care of you. Now, insurance companies, yeah, you've got to bust some balls to get what's owed.

I ordered 15 of those hitachi monitors and they got charged then cancelled. I never was informed of any lawsiut, I never got anything in the mail. Don't you have to sign up for a class action lawsiut in order to receive money.

What's this about just checking buy.com's records?

Not in an &quot;opt out&quot; class action. The only way you can avoid getting the money is to actually tell them you don't want it.

Sheesh! I ordered one, but I moved to Iowa and back to Tennessee since. I have no idea what address I used for shipping or billing back then... I wonder where they'll send a check to...? :confused:

I ordered one and went thru the whole card charged/charge rebated/order accepted/order rejected dance. This would be nice, but heck, I'd be happy if they just agreed to sell me a monitor at the advertised price.

How can I verify that I'm on the list?

They should not be responsible for a typo. In this country everyone is trying to take any opportunity to either get something for nothing/less or sue someone over petty things. This is insane. I would never be upset if this happened to me and I didn't get the monitor.

Hey! -- I've been working solid for the last few days, and I just got back to the forums.

W - M - C... Somehow, those letters have a familiar ring from yesteryear. :)

First, I want to say that if you weren't around back (WA-a-a-a-y back) when this was actually a current event that launched the Hot Deals forum, or you haven't otherwise taken the time to learn the facts of this particular situation, you might want to learn the whole story before you comment about whether someone is taking advantage of Buy.com's &quot;mistake.&quot; Suprise of all suprises -- For all the strange birds that scavange the web looking to rip off vendors, there actually are unscrupulous merchants who engage in shoddy business practices, as well. When this happens, the courts are their only recourse, and there really is such a thing as the law and justice.

In this particular case, I believe Buy.com was the bad guy. They had a history of advertising extreme lowball prices, some of which they honored, and some of which were unannounced specials. They also used to charge your card at the time of purchase, not when they shipped the goods. If you use a debit card, such as American Express, that means they had your money, right then. If your order was backordered for three months, they had use of your money for that time. Since this fiasco, they have change this policy and othewise cleaned up their act substantially. They also dumped their CEO of the time.

At the time, I posted that, instead of pursuing a class action suit, each person should file their own small claims suit in thier home town. As others pointed out, the lawyers take their expenses and fees off the top before the rest (if there is any) is distributed to the claimants. In this case, the actual value of each claim was about $450, the difference between the advertised price and the price one would have to pay to buy the same monitor, elsewhere. I know for a fact that almost everyone who actually did file such a case received a settlement from Buy.com, and they didn't have to wait a year and a half to find out if they were successful. They also had to sign a non-disclosure document promising not to reveal the terms of the settlement.

I know this because my monitor was acutally ordered by someone else, along with theirs, and charged to the other person's card, so I never had a claim under my own name. That means I know the terms of his settlement, but I am under no obligation to keep quiet. My settlement measures 19&quot;. :D

The best way would be to have kept a copy of the e-mail confirming your order. I also kept screen shots showing my order status as backordered.

I think that Buy.com is a good place NOW and wouldn't hesitate to order, BUT back then, they had a lot of nasty practices that got them in this mess.

1. Buy has always had a policy of having the LOWEST price around and if it was a below-cost loss leader, so be it. So, how did the users not know it was only a typo?

2. Operators confirmed it was a good price.

3. They fulfilled orders. They should've either cancelled ALL of them, or bitten the bullet and satisfied to original orders as a good faith move. The fact that they didn't even do FC/FS added to their grief.

4. They charged cards without intending to ship product. What if that charge was the margin of someone's credit line and subsequent charges put them over and incurred fees?

5. The Policies page had NO, ZERO, ZIP mention of typos being an escape hatch. When this blew up, SURPRISE!!!, they changed the page. Unfortunately for Buy, some smart folk saved/screen grabbed to old page. Ooops.

Personally, I would've been happy to buy at the advertised price. I haven't received anything about this. Was I supposed to sign on to the class or do they have everyone who's orders were taken that weekend? My e-mail HASN'T changed, so it's likely that I should be getting something.

I agree that the &quot;sue Egghead!!!!&quot; llamas are being ridiculous. I had a prob in my one dealing with Egghead and prolly won't buy from them again. That was an OBVIOUS mistake.:D

Hope they're better at lawyerin' than emailin'.

Yeah, I also got three. I think their bulk mail software is probably not the most sophisticated.

I received my notice.

It was not worth my time to go through small claims court, so I'm glad that I will be getting something.

I was one of the original WMC and posted on the old BBS back then. Buy.com has really improved their customer service and billing practices, but the lawsuit was justified (IMHO).

ps - I will put the money towards improving my SETI or RC5 firepower and help out Team Anandtech in the process

Wow! Never expected to hear about this again. One question... I've moved since then but they've still got my Email address as I received the notification. Do I need to do anything?
