The only way out of the corner he’s painted himself into is to declare an emergency and steal $25B from the DOD to build the wall. The buildup will be a shamble of half truths, exaggerations, and outright lies.

Honestly this is the stuff that impeachment was put in the constitution for. Abuse of power perched on a mountain of lies fits the bill.

What is this national emergency bullshit that people keeping throwing out there? There is no such animal under law. A President doesn't get to spend money in ways Congress has not authorized, period. The current shutdown shows quite clearly that Trump is aware that Congress has not authorized funding for the wall. If Trump raids the DoD budget or any other federal funds for a wall, he would be in clear violation of the law.

Such will be the inevitable court battle. Their argument is going to be pretty thin given the powers they are trying to invoke.

Doesnt there have to beban actual emergency, though? I imagine such an action would get smacked down by the courts in quick fashion.
Theres no 9/11, no ongoing war, nothing of the sort that is subjecting the US to any kind of state of security emergency.

If he declares the National Emergency for wall funding, would he simultaneously sign a spending bill without wall funding to end the shutdown? Wouldn't it be kind of dumb to declare an emergency *and* keep the government shutdown?

.. Maybe. I would certainly agree, but likely the courts would have to decide. Congress has clearly proven itself spineless with regard to this moron.
