FCC definition of indecent, obscene broadcast material
  • Obscene speech is not protected by the First Amendment and cannot be broadcast at any time.

    To be obscene, material must meet a three-prong test: (1) an average person, applying contemporary community standards, must find that the material, as a whole, appeals to the prurient interest; (2) the material must depict or describe, in a patently offensive way, sexual conduct specifically defined by applicable law; and (3) the material, taken as a whole, must lack serious literary, artistic, political, or scientific value.

Probably, but then again they'd have to be as they seem to be taking a monopolistic approach to radio. In any event, if the FCC finally is deciding to crack down on bad-taste and is the reason for Stern being kicked off, I'm not going to complain. This country is going to sh1t, and I blame it mostly on MTV and their standard setting for the youth of america.

Actually, it's been time to move on for like 5 years now.

I totally agree. He used to be funny but I feel he's just gone soft. Back in the day, he was the man, but, it's time to move on.

This Poll isn't about a popularity contest on whether or not you think he is funny. It is about whether or not you think he should be taken off of the air because he is offensive and should not have the right to broadcast his so called trash....

I voted yes since its a yes or no question, I say yes if he breaks the rules, there are rules put in place for what he can and can't say or do on the radio and he breaks them on a daily basis, when you break the rules you pay for it, I don't think he should be kicked off if he follows the rules however. This would be like anyone speeding and then getting upset because they get a speeding ticket, its the rules put in place, Howard knows very well what he can and can't do and he made the choice to break those rules with total disregard.

I think he should be off the air but only because he's boring and about as unfunny as a DJ could get.

Familiarize yourself with those concepts before you go talking about them. "Free speech" does not mean you have the right to say whatever you want without consequence.

Anyway, I could care less what they do with him.

Popularity and whether you think he's 'funny' is one thing, but censorship, and the way government is slowly but surely dictating what's 'good for us' is another thing in itself. Use your brain for God's sakes. Reading some of these replies in this thread really has me scared how little some of you actually use that thing inbetween your ears called your brain. Fvck no! First off he didnt break any rules. The dumb caller who said n****r did... Howard might be a bit raunchy, but so what? if it bothers you, dont listen to it. Its as simple as that.

I didnt say I blame the music. I blame MTV itself for promoting such things as young teenage sexuality.

no he shouldn't be kicked off the air, i don't listen to him, and i frankly don't really like him, but freedom of speech, and if you want to crack down on regluations you have to do it through out. This is just another way Bush tries to keep the American people down. If he talkes away freedom of speech, and he already has tried to take away our meirada rights, but classifing just about anything as terrisom and therefore we can;t get a lawyer. So i would say no and i think everyone needs to open there eyes to what the bush admin is doing

Taking Howard Stern off the air has nothing to do with religion. I think he should stay, I listen to another station.

I can't wait to get satellite radio (in 2-3 months - and it's going to be Sirius, not XM (partly owned by Clear Channel). The government is getting a little crazy with all this censorship crap! If you don't like it or get offended by the content - change the channel or don't listen. How hard is that?

Last month i was driving early in the morning and was listening to Howard Stern for the first time in over a year. I was laughing out loud the whole time, i kid you not (I'm normally a stuck up B!tch in the morning). His whole crew has chemistry and it's plain funny. Then the next time i heard about it was on ATOT.

I don't know what he said or did ( i guess he went to far), but it's a crying shame if he gets kicked off the air permanently. I know his content is lewd, sexual, not politically correct etc.. but it's a radio show, not a classroom. It's designed to make peoples commute a little more fun, although its makes them a little more braindead. Oh well.

Cliffnotes: All i know about him is that he makes me Laugh Out Loud and I'm sad to see him go (postcount ++, hehe)
