Add a poll option for "I dunno/don't really care".
Then why did you click the thread if you don't care? lol
Yeah, why bother posting.

do you have a suggestion for a card within about $50 of it?

You might be able to get a Radeon 9700 non-pro for just a little more. If not, a Radeon 9500 pro would be a little better. If you're feeling lucky you can get a Radeon 9500 non-pro and try to softmod it to a 9700 for $140 (I did :D).

i'd rather not do the softmodding. what about a 9700np to 9700pro. and i looked at the 9500pro I couldn't find any direct comparisons between the two. i guess i should look here huh?

You can overclock the 9700np to a 9700pro easy. If you get a Sapphire card you won't have to flash the bios to overclock, otherwise you probably will.

Link doesn't work. Just tell me which two you're comparing and I'll find 'em myself.

the black saphire 9500pro OEM and the bba 9500pro retail.

The red PCB is retail, which is why it costs more. I'd go with the black PCB. The black is just the newer model PCB.

Edit: Yes, anything in the Radeon 9500+ series & the GFFX series is DX9 compatible.

I don't think so. If a part is going to be problematic, it'll probably be within the initial warranty period. Even if the newegg warranty expires, you may still have one from the manufacturer.
