Bryant attorney Pamela Mackey wasted no time getting Detective Doug Winters to say that the yellow underwear the woman wore to her rape exam at a nearby hospital the next day contained sperm from another man, along with Caucasian pubic hair.

The 25-year-old Bryant, who is black, contends he had consensual sex with the woman.

Winters said the woman told him she had consensual sex with another man on June 27 or June 28 and used a condom, backing earlier defense suggestions she was sexually active before her encounter with Bryant.

...Bryant's lawyers this morning opened holes in the testimony of the detective who interviewed Bryant's 19-year-old accuser.

Attorney Pamela Mackey asked Eagle County Sheriff's Det. Doug Winters about his initial interview with the accuser. Winters said that the woman never told Bryant "no" during five minutes of sexual intercourse in an Edwards, Colo., hotel room June 30. When the woman resisted, Bryant stopped,
Winters said.

"When she moved his hand away, he stopped," Mackey said.

"Yes," replied Winters.

"There is no dispute he stopped," Mackey said.

"Correct," Winters said.

Mackey's measured tones contrasted with her confrontational style Thursday, when she brought an end to the first five hours of the hearing with a suggestion that the woman had had sex with two other men in the three days leading up to the encounter with Bryant.

The defense team apparently showed Judge Frederick Gannett in closed session that there was a "good faith basis" for the comment, because Mackey was allowed to pursue a similar line of questioning today....

So all because it says the prosecutions stuff is weak and pathetic, its automatically biased? Please do tell me how you think the prosecutions case is strong otherwise.

I don't see how any can believe Kobe is guilty beyond a reasonable doubt with what we have heard so far.

Well, if the judge doesnt bind it over for lack of probable cause, he could always convene a grand jury to indict him in which case there is no probable cause hearing by a judge (it is already done by the grand jurors) and then a trial would be set. However, would he do so under the circumstances is another question.

Uh, guess what? If your own wife can't trust you, why should I? We all know he's scum, and it's her word against his. Is she more of a scum than he is? Quite debatable. It's going to trial...

Yes, it's a new fad, "Colorado Rape." If you are rich or famous and having consentual sex, it's rape.
