Have to admit it is an odd sort of search. I suppose warrants confer nearly unlimited power these days in the land of those who still believe they are free.
Judges can do anything as long as they aren't overruled by a superior court.

They can rewrite a law as a tax.

They can give the ability to have religious beliefs to a corporation.

They can free slaves.

They can even have people put to death.

17 year old in possession of a picture of himself is not child porn unless you live in a police state which you clearly do.
15 year old girl in possession of pictures of a 17 year old boy is certainly child porn under the laws as written.

Everyone old and young who has gone through tsa screening to board a flight has a photo of their junk already on file with the government. It's nothing to be ashamed of.

For some reason I think the headline actually is "Police want to scare a teen by threatening to take a picture of his junk."

The only question left is, who is paying for these threads to be posted here, and how much do they pay? I want in on this revenue :)

Actually they didn't get that authority and just made an update with the Washington Post saying they would never do such a thing. Apparently your not keeping up in this thread.. not surprising..lol
That's a stretch. They said it wasn't the policy of the DA or the PD. They omitted whether they had a warrant compelling them to perform that search.

I would think someone that posted so many threads lambasting the police for their bad acts would be good at decoding weasel words.

If you follow my posts, you'll see I'm big on enforcing laws as written which cuts both ways.

For the third time, this is a bad law. At a minimum it should have some sort of Romeo and Juliet provision.

Challenging the authority of the police to collect evidence does not move us in that direction.

I didn't see a mention in the article where she sent pics of her junk to him. Did she?

If she did, she is as guilty as he is of manufacturing and distributing child porn according to the statute as written.

Foster said the case began when the teen’s 15-year-old girlfriend sent photos of herself to the 17-year-old, who in turn sent her the video in question. The girl has not been charged, and her mother filed a complaint about the boy’s video, Foster said. The male teen was served with petitions from juvenile court in early February, and not arrested, but when the case went to trial in juvenile court in June, Foster said prosecutors forgot to certify that the teen was a juvenile. The case was dismissed, but police immediately obtained new charges and also a search warrant for his home. Police also arrested the teen and took him to juvenile jail, where Foster said they took photos of the teen’s genitals against his will.

I know but we have some seriously religious right wing nuts that have sort of taken over this country..lol I mean from trying to get rid of higher education and dumbing down schools and making it difficult for women to get birth control, this is really about the religious coming out in force and punishing people for sex...omg sex.

Practically every Teen has a device where they can have Private conversations with other Teens 24/7 and the same device can take/send Photos and Videos. I suspect there is more "Child Porn" than actual Porn already.

This is a case where Technology has rendered the Law and Social Conventions obsolete. Perhaps better stated, what was once only done Person to Person is now done on an easily trackable medium that Others can also experience by way of Recording. Fundamentally, this is the Law, meant to stop Criminal Activities, now Criminalizing behaviour that has always been a part of life.

Now I'm not saying that Teens should just start sending Sexts as if they were like saying "Hi". Clearly there are many reasons why it's best that Teens should be discouraged from doing this kind of thing. However, tossing kids in jail is not a good way to address it. Especially when no one has been coerced or harmed.

I'm not one of these people who says that male child molesters deserve prison and female molesters deserve high fives.

These statutes should be applied evenly across genders.

I'm surprised that so many of you are in favor of anarchy and reserving certain laws for only unpopular "criminals".

That is true injustice. That's what almost put Dave in prison, a badly written and rarely enforced law.

The statute is bad. That does not mean that it is unenforceable.

Also just FYI age of consent laws are a Democratic/liberal creation. Republicans/conservatives and the religions that make up their base traditionally believed in marriage in the early teens. My great grandmother was married at 12. Granted, almost 100 years ago but still.

I suppose though in your simple mind it is easier to dismiss me as a "right wing nut" than it is to read what I'm posting and consider an alternative point of view.

Terry, you know by know I'm not the one to play this game with. Go read the post you replied to then re-read your reply. You clearly overstated whatever case you were trying to make.

This was the post you replied to:
Taking a picture of a tattoo, say on your arm, using an electronic surface mounted device is slightly different that shoving a needle in a boy's penis to force an erection to take a picture.
Both pictures likely end up in a database and I would think that the penis picture is a violation of his rights if this is the case.

Now this your post:
You would be incorrect. Case law is clear, the courts have processes to deal with explicit photos of children as evidence, this is no different.
"Forcing a needle" to cause an erection is no different than forcibly collecting blood for a BA screening, either in discomfort or scope.

Xbiff had one point in his post and you said he was incorrect about that and pulled the case law point out of your ass to prove his supposed wrongness.

Drawing blood is substantially less invasive than giving someone something intravenously to force them to have an erection. That is a no brainer.
