Yeah but it's one thing to buy a crappy car as opposed to sinking a small fortune into the same crappy car.

Too much testosterone I say. One night, I'm driving from the mall back to my place, starts revving engine next to me, I didn't pay attention. Car next to me keeps pacing me in next lane. I still dont make eye contact. Guy rolls down window, throws soda can into the car I was in (not mine). I dont know what he wanted to prove. Outta stupid rage and balls that needed to be defended, approach next stoplight, revved engine, waited for light to turn green while in right lane ...

then I just decided to turn right. Yea, Im a wuss, but I'm still alive.

But they are facing a civil forfeiture for a CRIMINAL act than prejudces a jury or judge as to whether or not to seize property. A civil court should not base forfeiture on a criminal conviction but rather something that violated civil laws which street racing DOES NOT.
It does when we write those laws, like they did in New York City to seize the cars of drunk drivers. How do you think civil laws got there? Someone wrote them. Just write another.
Do you not see my point? We are using the Civil Court to make up for the lack of a forfeiture law under Criminal Law.
It is another legitimate avenue to sanction wrongful acts. We have at our disposal both criminal and civil. We use one or the other based on its advantage in solving a problem.
The system has a rhyme and reason to it and it should not have crossing boundaries when we compare private citizens and criminals. Either give Criminal Courts asset power in a limited scope relating to the Crime at hand or conviction or forget the whole thing.

A Civil court has no business determining a criminal conviction as basis for a civil forfeiture.
Oh but it does. Are you saying that if you kill someone drinking and driving, your conviction for that act is not a legitimate thing to use against you in a wrongful death civil suit? Of course it is. The burden for criminal conviction is much higher than civil "guilt".
