Please help me to put THIS GUY DOWN...

I currently came across a deal w/ this guy on Ebay (his Ebay ID is km-electronics). He is selling a 24X CDR for most people (300+), but it is the 8X CDR (Samsung SN-308B). When I emailed him, he insisted that he sent me the correct one despite his description in his auction. Ebay only protect people between 30 to 60 days. I want to put this guy down , because of his bad reputation and cheating. Could you help me out? I include a copy of his email. Thank you.

"
Let me help you

R stands for READ

W stands for WRITE.

Cd-R means it reads a CD-R, a CD-RW or any CD at that speed

CD-RW or W means it writes at that speed. R=Read , W=Write.

This is not to hard to comprehend.

Hey, if you don't want it, send it back for a refund of your winning bid. We
do not refund shipping charges.

It must be IN THE EXACT SAME CONDITION YOU RECEIVED IT WITH ALL PACKING
MATERIAL in order to receive a full refund of your winning bid.

This is our offer, keep it or return it for a refund of your winning bid.
Please include item number, auction info and your paypal information.

Positive Feedback must be left prior to your refund since retaliation is
unacceptable and unprofessional.

Sincerely,

Keith & Marlo

BTW, you should be aware that the real drive you could buy at Dell (24X CDR)
is about the same price you are selling on Ebay for the refurbished item. If
they really find out about it (all of the people you have sold and Ebay),
you
are screwed. Don't say that 24X CDR is the read speed, nobody says that. It
is
the term for the recording speed that the drive is capable of. The RW stands
for the rewrite speed, which is in this case, your drive is only capable of
4X. Final words, I am not a novice user nor a novice technician. I am
working
for a school technical deparment. Perhaps, you should know that.

Dude, wtf IS HE smoking? CD is CD read speed. CD-R is CD RECORDABLE speed. CD-RW is CD REWRITEABLE. You have been sorely misinformed.

Edit: aimed at letter writer...misread quotes..my bad.

Just so everything's clear here - "24x CDR - 10x CDRW - 8x DVD - 24x CD" is splattered everywhere on the auction listing (no less than four times, in an assortment of massive fonts and colours.) The X200 only has that drive as an option for a DVD/CDRW combo - the 8x/8x/8x/24x he sent likely won't work with your unit.

petez was the purchaser here. I could obviously see why he should be expecting his 8/24/10/24 unit and not what he got. The seller is definitely playing shady business, and should take the drive back and give you the one you purchased.

Again, petez - how did you pay for it?

I used MO. I still have the MO receipt. What I don't understand about this is how a guy like him would end up selling 300+ items for 300+ without anybody complaints about. I want to put him down so badly, don't you?

I would contact ebay about his selling practices. He clearly misinformed you about the specs of the drive (hell he even admitted he has no idea what hes talking about in the email he sent you with R= and W=).

Id go midevil on his ass. His is clearly a friggen moron.

Interesting. Quite the con artist... reminds of some of those rip-off jerks in the bad mom-and-pop computer stores who pick on the stupid. :|
Gotta love Ebay, they're a breeding ground for this kind of thing.

btw, with feedback of 1630-10-15 in the past 6 months alone, I don't think you can do anything to "put this guy down," at least not through Ebay channels. You may want to file a fraud complaint with the postal service (you used MO) and your local police.

LeeTJ, it is his email address. I doubt if my local police will do anything about it. As about the MO, you can't do anything before 60 days you send it. Hope this would help.

u should ask him... if 24x cdr = 24x cd read.... then what the hell does the 24x cd part mean?

ok i just read the earlier emails... this guy is either an idiot or a scam artist. how much did u pay? i know safe harbor charges like a flat rate of $20 or something, so i dont even know if it will be worth the hassle. and this guy apparently does not seem to give a shiat about negative ratings. looks like u might just have to suck this one up in order to aboid further losses. what i would do is email all the previous winning bidders and tell them about it. then maybe collectively, u guys might be able to do something. also... i would try to contact all the current bidders in his auctions and have them ask specifically what the speeds of each function are. then everyone else will know what a idiot/scammer he is.

Was it a Postal MO? Either way, contact your local postmaster, not the police. Mail fraud is federal...

Actually, you want to contact the police in the city where the seller is and ask to speak to someone in their Internet Fraud Division.

You are right, they are wrong. Leave negative feedback, contact ebay, get refund.

I had one like that after a while back... he sold me false products exactly like yours...

Is he still selling those products to other people? What I did is Emailed everyone who bid on his products and informed them of the situation... then I emailed other people who have bid on it already to find out if they had the same problem... The people who had the problem with me we kept everyone in the know about what's going on. And we tracked him down with what information we had and first talked to his parents (he didn't like that :))

we also all filed complaints with ebay, you can file complaints before the 30-60 days. If you send enough complaints they will do something about it

He got his account / Credit Card Suspended (he can't sell on ebay with that credit card anymore) And after talking to him personally and his parents, he sent out an appology letter and gave everyone a refund (partly cause one of the guys who got ripped off was a lawyer, and he got ahold of the DA in his state)

[edit]
I must add you can file a complaint with ebay and they say it's not their responsability to fix it, I had to go through 5 declines before I got ebay to do something about it. Just keep sending a complaint a day until they do something about it. And make sure everyone else who gets ripped off sends one in too (I would provide the link for them to click on in the email, then they'll have a better chance of doing it)

Basically, what I want to do is asking him to refund half of the price for the item (as for other people has has sold). No police involved.

I couldn't find the part number on Dell's website. The only drive they sell for the media bay is a 24x read, 24x write, 10x re-write, and 8x read DVD drive. I don't really know what to say. The part number he lists on his auction isn't a valid dell part number, so we can't look up the drive and compare.

My recommendation is to return the drive, get most of your $$$ back, and then leave neutral feedback. Either that or try to file a fraud complaint. Good luck.

heres a link to the auction Yeah you should email him again and tell him that you want the right product sent to you. It looks like he has good feedback. Have you contacted ebay about it? Also you could try telling him that it was doa perhaps, then he might send you a new one.

Take his off of a refund minus shipping fees. Now you have at least some of your cash. Then go after him with the negative review and all that... I just wouldn't waste my time though beyond the negative review. You have to cut your losses somewhere.
