Please help me! I think I just got ripped off!! (yahoo auction)

help everyone! I think I just got ripped off on yahoo auctions and I don't know what to do.

Here's the story:
I bidded on the new sony palm NR70V from yahoo auctions on 5/20. At the time, the seller (blue_pistachio@yahoo.com ) was selling two NR70vs and had a rating of 1. I won one auction thinking I had scored a hot deal at $480, item retails for $599. On 5/22 the seller emailed me requesting payment be made either by mailing him a check sent to:

Henry Johnson
337 Elton Hills Dr
Rochester, MN 55901

or paypal to his email address. I opted to use paypal and he sent me a paypal money request, which only let me use my bank account to make payment. I should have been weary then.

He promised that my package would be mailed the next morning. That was on 5/23. Today is 6/3 and I still have recieved no package. I have emailed the seller several (3) times and have recieved no response. No tracking number given, no reassurance given. Nothing. Everyday that passes by I keep waiting for the USPS delivery guy to show up or at least an email from this guy, but nothing.

Today I filed a complaint with paypal, that's all I could think of doing. Yahoo won't let me file a complaint until 25 days after the auction is over. What else can I do? I have this guy's supposed address.

I checked paypal and he is an unverified member. I went back to yahoo auctions and noticed the winner of the second of his two auctions posted a complaint as well as negative feedback, I did the same.

The thing that REALLY REALLY pisses me off is that if you check this guy's live auctions, he is selling the TWO EXACT SAME items he's sold before and has cheated people before on. Its bad enough knowing I got cheated, but to have two more people out there swindled as well - now that is just some serious bull$hit.

Please help me. What can I do to 1) getback at this guy, 2) get my money back 3) make sure no one else gets frauded by this person? Thanks and any help is much much much appreciated.
 
You have his address, see if you can verify that it's his REAL address, then you can take a course of action.
 
Sorry to hear you got ripped off... The only thing you can do is submit a complaint to yahoo and paypal and let them take care of the problem. You should also been aware of who your sending money to, whether its by paypal, cashier's check, money order, etc etc. First of all, I would have never send money to an unverified paypal member. Second of all, in purchasing auction items in that amount, you should have used an escrow service, or ask him to ship by COD.

I know this may sound cruel, but let it be a learning experience as everyone gets ripped off at one point in their life.
 
shotgun steve. Thank you. That was very very helpful. Now I just hope the address this jerkface provided me is in fact his correct one. And I need to wait 30 days i think it was before I go through with the prosecution.

I just want my money back! OR this scumbag to email me. I can't believe this guy is selling the same two items he has frauded two people with (me and another buyer) on yahoo auctions again!

No problem. You would not believe how fast some of these people jump to send your product or refund your money once they actually get a call from the cops. 😀 If you have any questions, feel free to PM me.

if he is still selling it yoyoyoo, then do this try and do another phantom deal with him and either get a work address to send the mail cheque to, get his ip address from the yahoo site and trace it back, or get a phone number, if you insist on sending a cheque he will have to send you some kind of receivables address. also charge him for your time and threated him with criminal prosecution, in the uk you can pay for a private one if the state wont do it.
