I don't understand your point. If we hadn't invaded their country the guy wouldn't be dead now. How does that justify the invasion to you?

Because that is defined as combat. If you're engaged in war and playing a part in it, contributing to the enemy's war effort, then you're a valid target whether you're on the front line or not.
