I got this ad via email. Not sure if it's legitimate, so please be cautious. Anybody ever dealt with this company?

Photoshop 7.0 Full Retail (OEM version - no manual) - $39.95 + $5 UPS shipping.

I read somewhere that PS is the most often pirated software in the world. This is obviously pirated, so if you really want it you can easily download it yourself. But I think I will drop abuse@adobe a note and let them know about this.

This is illegal, and it has now been reported to Adobe anti-piracy for appropriate action. The moderator should shut down this thread now and remove the link.

Anyone STUPID enough to send money to an unverified, new PayPal member for a product that is illegal to sell in this form anyway DESERVES to loose their money, but at least Adobe should get this site removed quick enough to prevent anyone from loosing money.

How can you say for sure it's illegal when it could be an oem? I'm not saying I'm willing to jump all over it, and unverified paypal sounds suspicious, but how can you say for sure its illegal. I bought WinXP full pro for $42 from a thread here, and it was completely legal.

Legitimate businesses do not use paypal as their primary form of payment, period.

If they're aren't legitimate enough to have a merchant account, they're certainly not worth trusting your money to.

It is ILLEGAL to sell an OEM copy of ANY software at "Retail" (direct to consumer)

There is a reason they make OEM discs.. to include with hardware at a low "cost of goods".. E.g. no retail box, no manuals, no security devices inside it for retail stores.

Also at a price break in large quantity to big manufacturers.

The hope is from the maker that by including it with some new hardware at a reduced cost will get people to use the program they might not otherwise buy, THEN get them for full retail value in future upgrade purchases.

To show you how much companies like Adobe or Microsoft do NOT allow resale of OEM product without the original hardware they were included with, search eBay open auctions any day for "OEM ADOBE" or "OEM MICROSOFT". Then go back 2-3 days later and bring up the item numbers of the auctions you found the first time. Most every one will be "Invalid Item #" now after they remove the illegal auction from the site.


Yes, I work for a major software company and know this to be true. Whether or not you agree with the licencing terms you must abide by them, and selling OEM software in this fashion is illegal according to those terms!

a) Totally valid. You got true, "not for resale" software because you are a partner/isv with ms. Just hope it isn't being resold.

b) Totally invalid. You lied claiming you are a company/system integrator/etc.. to obtain a piece of software that was NOT intented for you.


Take your pick. I'm not claiming you are/were one or the other, but I know a LOT of people here were "B" based upon the many posts to that message thread regarding "making up company names".

Illegal is illegal, no matter how you look at it.

Getting things cheap because of legal means is one thing, lying or buying them from someone who is lying is something totally different. Viva the legit deals, and lets hope the shady deals disappear.

Well yes and no. There WAS a deal just before the launch of winxp, where you got the FULL version of winxp sealed retail DIRECT shipped from MS for $52 (the $42 the guy quoted didn't include shipping I dont think). If that's what he's talking about it was a legit deal. Even though that was supposed to be a NFR version, MS shipped the full thing retail boxed. There was another deal for a FREE copy of winXP direct from MS, but that one was definately labeled NFR, and you just got the CD. However, in neither case were they OEM versions.

Anyway, I agree that photoshop is like one of the most pirated apps. You can easily tell who's doing pirated by browsing the listings on ebay. BTW, don't bother to even put in a bid on ebay, most of the stupid people on there bid it up at or past retail prices. And the ones that aren't are definately pirate version (many of them claim to be "backup" copies). I regret putting in a bid at all there for that, because I got deluged by people emailing me offering to sell backup copies.

Currently the cheapest PS 7 deal I know of is the upgrade from amazon for $139 and a $50 mail in rebate. I just got that myself.

If they priced it based on skin color the people would be all over it...
All this pricing sounds a little hypocritical to me...

1. i'm getting the impression that you are confusing the first amendment with the civil rights act.

2. civil rights act makes no stipulation regarding age or educational status.

to answer your question, it IS age discrimination, it is NOT illegal.

Two words: State Action. The bill of rights only applies to actions by the government. Originally it only applied to the federal government, but the 14th amendment has been used to apply most of those rights to the states.

So, for instance, your mother can tell you to shut the f up, and it's not a first amd violation. If you're public school tells you to, it might be.
