PayPal .... finally ofers refund

If I don't vent I'll scream.

Bought an item for $45.00 in Nov. Got it. Not as pictured. Seller argued but agreed to take it back. Shipped it to Canada. Seller refused to accept it because of $30.00 duty. I countered OK to subtract duty from refund. i.e. only give me $15.00. She areed. Next day - asked me what feedback I would leave. I said factual. Accused me of being vicious and said I would post negative - so refused item (again).

So I filed with PP dispute res. (Per eBay instructions) Explained details. Offered to show them all emails and comparitive photo. PP answer was 'item as described' no refund. I called. PP rep told me to appeal. I appealed that night. PP response today was 'we don't have an appeal process for dispute res'.

So the lesson I learned and I am sharing:

Never ever believe that PP dispute res is a valid safety net. Not once did they ask for my photos or email where she agreed to take the item back. They basically went to her post. Looked at it and told me that it looked right to them. That's like asking the 'wolf' if it ate the chicken. The 'wolf' says no - and they go OK.

Don't get me wrong. I'll continue to use PP when I have no choice, but only under those conditions.

Please PM me with any legit and easy to use alternatives so I don't have to support these morons anymore than I'll be forced to in the future.
 
Paypal does Not offer buyer protection in many auctions. Buy from those auctions, if your scam your SOL.

Link to the auction. Did it say buyer protection?

If it had no Buyer Protection, Paypal didn't blow anything. If you buy an auction without Buyer protection, you are buying at your own risk. You have no protection in these auctions.

Yes. There was buyer protection on the item.

This is more about PayPal not requesting any proof from me than about what her sales post looked like. I have multiple emails where she agrees to refund but then refuses.

I have photos showing the white/grey item in the eBay photo was pale orange...and in this case color was everything. In hindsight the photo was probably over exposed. I can't say it was intentional - but at the least it should have been pointed out in the description.

Just need to vent:disgust:

Are you just assuming it had buyer protection, since it had paypal. Having Paypal doesn't give you buyer protection.
 
No. I know it had Buyers Protection.

I have bought enough off of eBay to always look and know what the risk is.

Yes - it's $45.00 - so it's not too big a deal.

But for someone elso who might buy something that's more - say $450.00 - please keep my experience in mind.

 
Oh and about charge back....

I was foolish enough to say in my email correspondence with her that I would abide by PP and eBay's decision. For $45.00 I am not going back on my word whether dealing with a liar or not.

Now if it were $450.00....

I'll contact eBay tonight. It was through their 'live chat' that I found out that since I had 'Buyers Protection' I had to start with PP. It occurs to me that I may have recourse with them - but considering how closely they're linked I doubt it.
 
I got another reply from my PP appeal response.

Over the week-end I got an email from their 'Protection Services Department' requesting a fax of all the proof...

that the returned item was refused by the seller.

This morning I faxed them the UPS tracking detail that shows it was refused 3 times. And I also sent two emails - one dtd 12-13-05 where she agrees to take the item back and another dtd 12-20-05 where she says that she is refusing the item.

Now we get to wait (again) and see...

I am not getting my hopes up, but I felt obligated to let everyone in on the whole story.

Update = Appeal denied.

I had to call them....

In the past all Paypal responses have been sent to my email address. This time they did not contact me at all.

I called to ask why they even bothered to request I send in proof she refused the item and why it would be denied since my proof is so clear. (UPS printout) After putting me on hold she had no answer. But she did offer to send me to a 'supervisor'. This supervisor also put me on hold to discuss the 'why' with the original PalPal Appeal Supervisor (Who - it turns out - was not part of the appeal denial decision!!!).

Well... she came back on the phone and said I WILL HAVE A REFUND IN 3 -5 business days !!!
 
so basically paypal/ebay is like the wild west, anything can happen, there are no guarantees
its like a big game, not like real life business where facts and stuff matter
 
I absolutely hate Paypal, unfortunately it's got internet person-to-person commerce in a headlock. Maybe a month late, but a new year's resolution is to start offering another service like bid-pay or something when selling stuff here or abroad.

I wouldn't say this was any different than disputes I've had with BB or CC - and those are 'real life businesses'. (Aren't they) The difference has been how long this took and doing through the net.

Certainly not having the same person review a file leads to inconsistencies - but this situation is not unique to PP.
