paypal dispute - update, i won.

sold HD2 on ebay. it worked flawlessly prior to sending it to the guy. i never hear anything from him until today(over a week after him getting it) and he files a paypal claim for a refund. the buyer said it won't hold a charge. that's bull shit as the phone worked perfectly. i even sent it with almost a full charge.

i had $100 balance i was going to withdraw today and i can't get to it because of this dispute. i'm not letting this guy send back a bad phone that more than likely he fucked up. does that mean my previous $100 balance is in paypals hands?

god damn it i'm starting to hate dealing with fucking idiots over selling items.


update:

well, just logged on my paypal account. i won the dispute somehow. he never shipped it back. he replied a few times after making the OP via ebay about how i ripped him off but never mentioned a tracking. guessing paypal saw no tracking and overruled or he closed the case.

either way what a headache and i'm glad i didn't get screwed by the asshat ebayer.

yes, i had a 3 day return policy on the auction. i'm not giving a refund when the phone worked FLAWLESSLY and was packed very well only to get a dead phone back and be out $380 bucks.

and yes, fuck paypal. that $100 balance had nothing to do with the money he sent me yet they said they were 'holding' any funds related to that specific transaction. wtf?
 
Paypal always sides with the buyer. Be prepared to lose no matter how unreasonable the claim is.

well i guess worst case scenario they keep the $100 i had that they decided to hold. they can't pull money from my banking account tied to it. paypal and the buyer can get fucked.
 
Paypal/Ebay now selectively holds any payment >$100 (for certain items?) from the buyer until they leave positive feedback or the package tracking information shows as delivered. Unless you sell expendable cheapass trinkets, this leaves a lot of potential for buyers to abuse sellers such as in the OP's case.
 
Damn that sucks, you might be able to get by w/ the 3 day return period listed since that does make it a contract, but Paypal does have the tendency to go against the seller. Good luck, update the thread when possible.

There is no substitute. Google checkout is a joke if you consider the userbase and IRC, you cant use it for ebay. To not use ebay/paypal is to not do business at all if the person is unwilling to craigslist etc.
 
No, they can't withdraw money from your banking account without your consent. They lost that lawsuit years ago. However, if you authorize them to withdraw $25 from your bank account for an item, they will pull $25+whatever you owe them because you authorized them to withdraw money from your account. They can also piggyback a credit card charge, too. So you'll either need to pay up or never use PayPal again. And they will send you to collections if the amount is hundreds of dollars.

This type of bullshit happened to me enough back in 07/08 that I shut down my Silver PowerSeller account. I sell stuff on Craigslist now. Unless you live in the middle of nowhere, you'll usually get 20-30% less for an item on CL vs eBay. However, given the cost of eBay fees, shipping, PayPal fees, and dipshit buyers vs. cash & carry...Well that's why I don't sell on eBay anymore. Also, our own FS/T forum is solid.

uh doesn't the buyer have to return the item before they'll refund? I had a buyer file a dispute on a motherboard I sold and they made him send it back at his cost first.
 
They will make him return it though first, but what is too stop him from mailing a rock? I opened my package at the Post Office with a supervisor watching me open it to verify.

The buyer has to provide PayPal a delivery confirmation. They don't have to send back the item they're returning. That happened to me twice. Fortunately once the scammer still lived with their parents and that got resolved after a few phone calls to their employers, ha. The other time I lost about $50.

You'd think that would cover your ass but it doesn't with PayPal; they really do not care. However, it will help with your police report, which might or might not lead to a satisfactory resolution.
 
i'm not refunding him.
they can close my paypal account. i have more than one(unless they blacklist me???).

god damn it. i'm going to shit in a box and mail it to the dick smear.
