Passenger side mirror smashed by construction equipment

I was driving through a road construction area this morning. It was pitch black and there was equipment on the sides on the road.

The lane I was in was reduced in size due to the equipment left there over night. There was no way to move over (due to traffic).

I tried to stay near the center line when something on the side of the road smashed into my passenger side mirrror.

I e-mailed the traffic dept for the city gov't. Is there any chance they will pay for the repair or am I SOL?

I suspect that they'll put the liability on you... they may yell at the construction guys but I would be surpirsed if you got reimbursed. Hope that I'm wrong, though.

Fortunately it's a cheap part (<$100). Shouldn't be too hard to replace.

You should have pulled over right there and lodged a complaint with a foreman. By leaving the scene, they can say it may have happened anywhere and that you are full of crap...

There was no one working at the time, this was at 6:00am. It was too dark to be working.
