Out of print material and Pirating

Is there anything "wrong" with using torrents to get out of print software? The publisher hasn't made it in years and no store would have it in stock any more. There may be the remote chance one could buy a used copy on an auction site but how does paying 10 - 20 times retail "help" the creator?

No, because I know my "sharing" will decrease the amount of rare wine you have, while downloading out-of-print software will not change the source. How cool would it be if that were true for wine...

Sites like GameTap and companies like MS and Nintendo are paying creators to re-release old software so if it's a game then yes, piracy could hurt the creators by removing demand for a paid re-release.

What are you planning to "infringe"?

Yes - not to delve in this discussion again, but copyright infringement is NOT theft.

More on topic, I used to be fairly involved in 'abandonware' games.
 
most ISPs have deemed torrents against their tos, and will dc you. i played world of warcraft at a hotel during patch day, and got about 93% done when they finally realized it was a torrent download. i had to call and explain that it wasnt me downloading movies, the only reason they turned it back on was the supervisor on duty plays wow also.

I pretty much live in a hotel during the week for work and I've never had my access shut off or capped because of torrents. I was uploading all of last night/evening/this morning at 150-200kb/s w no problems.
 
this was the royal pacific resort in florida, the speed was about the same as a crappy dial up, and they shut it off after about 45 min. the best western doesnt seem to care much tho, but cox and qwest have it in their agreements. verizon broadband has a clause in there too here in az... just got a new card today for one of the PMs here.

i've always wondered this in regards to movies. Say there was a movie that has gone out of print and was released on vhs only. The only place you can find copies is on ebay for 100 bucks. Is it wrong to download a copy.
