All the OEM XPs on ebay com with some hardware to fullfill the agreement. What agreement? Is it the hardware it came with? Does it need to be to be legal? What is COA? Is it legal? What are your veiws?

OEM (Original Equipment Manufacturer) Licenses say that they have to be sold with new systems. People take that to the extreme and sell it with any new hardware... thus, people will sell an OEM CD with a mouse or floppy drive and feel that they've stayed within the letter of the agreement.

COA is the sticker with the CDKey used for installing XP on it that goes on the side of your PC case...

Ebay's deffinition:
Original Equipment Manufacturer (OEM), or bundled software, is software that is obtained as part of the purchase of a new computer. OEM software licenses usually prohibit the purchaser from reselling the software without the computer or, in some cases, without any computer hardware.

Not usually..

Does it need to be to be legal?
Yes, But doesn't allways end up being.

What is COA?
Certificate Of Authenticity. The license MS provides you to use their software.

What are your veiws?
I personally don't mind getting OEM software(allthough I won't get it from eBay) as I am usually getting internal hardware anyway and it saves a ton over retail box price. Only neg for some people will be that OEM software gets none,zero,zip, zilch, support from Microsoft. I don't need thier tech support, just good price.

Why not simply use the Internet to get better, faster support? Who needs M$ support, anyways? ( I am referring to the averagre user)

That is why I said some people. Mom, Pop, and Grandma may not exactly know about Anandtech. Mkay..

Would you sugest that I buy retail or OEM from Ebay? Is there an EULA for OEM online, linkey mabey???

I've purchased OEM from eBay a few times and had no problem. I've gotten some software for dirt cheap that way.

However, if you're looking to get Windows XP, I'd say you WON'T get a good deal on eBay. Many sellers ask too much knowing that some people just assume that because it's an auction they are automatically getting a deal.

To get an idea what something is worth OEM, check out pricewatch.com to see what online sellings are charging. Then you can see if eBay is worth it. Also remember, if something does go wrong, it's usually easier to resolve through a bona fide dealer.

In the Win98/NT4 days and before OEM OS purchases could only (legally) be made in one of the following manners:

With a complete system (of course)
With a Hard Drive
With a MB/CPU purchase

All others were not legitimate OEM license purchases. Some resellers have gone to the extreme of including some old 72 or even 30 pin SIMMS with the license in an effort to make it look legit. When in fact it isn't.

BTW, the instances I listed above were direct from MS as I was reselling HW and OEM OS licenses between 1991 and 1997.
