Wow... Royal Oak... not too far from home. I don't particularly care if people exercise their gun rights, but making a scene out of it should be a crime in and of itself.

Given the proximity of certain nice areas in/near the Detroit Metro Area to shitty areas I thought it was a given that certain behaviors would garner the attention of the police more than they would in less crime ridden areas. Didn't seem like he made that big of a scene - I've seen far worse from people looking to provoke a confrontation

I am ok with them asking for ID as long as I am allowed the choice to present it or not. The encounter with the second officer is how it should happen. The first officer is an ass.

It seems crazy to me that you don't have to present ID or firearms license upon request from police. To me if you want to carry a gun down a road then it should be like driving a car, if you choose to do so that is fine but you should have to have your license on you ready to be presented if asked.

:confused: Why are you comparing a constitutionally guaranteed right and a privilege? I would certainly not expect them to work the same way as they are not viewed the same way under US (and especially Michigan) law

Exactly. Fvcking annoying. The only reason for him wearing a rifle like he did was to start shit. You don't carry a long rifle on your back for self defense, and he sure wasn't going out hunting. IMO, they should append that open carry law to state, if you want to be a shithead and open carry a rifle, you need to present ID when asked by law enforcement.

I fvcking hate assholes like this. Yes, the cops are being assholes for responding to someone doing some stupid shit. :rolleyes:

From what I read, that doesn't apply. Failure to Identify in Texas only applies after arrest.

I don't think you should just hand over your rights because someone asks. I believe you should be able to carry a firearm if you received proper training and have a permit to do so (though some states do not require a permit). But I don't think you should be going out for a stroll to Redbox with both a handgun and a rifle. The guy clearly was looking for confrontation.

First cop is an idiot and should be booted off the force. The second one did the right thing. Since when did exercising your rights, doing something perfectly legal under the law become such a problem?

I would expect it to be required when doing this type of thing in the first place. For all we know you might not even be a US citizen or have some criminal background. I always think of the days in the wild west when I see this type of stuff.

It's one thing to be exercising your rights, its another to be up in arms about it. If it didn't seem like these guys were looking for confrontation, I wouldn't have any issues with these videos. What kind of right are you freely giving up by presenting an ID? I hope these guys only spend cash and never submit their name to anything anywhere. Wouldn't want to give up their rights...

You don't understand. For decades, when you carried a handgun openly the result in the same, even though the Michigan Supreme Court (and opinion of the Attorney General) decades ago noted the state constitution protects open carry throughout Michigan in any public areas, with certain exceptions with restricted access (court buildings, schools, and the like). Cops would come and harass you, try to tell you its against the law to open carry, or arrest you for 'disturbing the peace', 'inciting a panic', or whatever else they can arrest you for. They have even arrested people for having a "concealed" weapon just because the bottom of their shirt or jacket was covering 1/2" of the butt or grip of the gun, even though the rest of it was plainly exposed and visible. IIRC, there was one case where a guy was arrested for having a "concealed" weapon, because the gun was in a HOLSTER. i.e. the holster was 'concealing' the officer's plain view of the weapon.

It gets dismissed, convictions overturned, or prosecutors decline to prosecute, but you need to hire an attorney (if you're not savvy enough to handle your own case) and months of your life are spent fighting it. And then there have been cases where a person's firearm "went missing" while in the possession of the cops, even though they are REQUIRED to return it upon dismissal of any charges (or prosecutor declines to file charges), and you have provided sufficient proof the firearm was lawfully owned and registered. In other cases, the firearm was returned damaged. Then you have to sue the police to reimburse you for the cost of either the firearm or to repair the damage someone did.

A number of jurisdictions/agencies have been very tolerant of it, but many more have a long history of the aforementioned behavior, where they feel they can do whatever they want. Well now many of them are getting the message that they CANNOT do whatever they want. Courts have come down against them for it, thanks to people like this who go out and DARED to exercise their rights.
