Landmark Case Involves Alleged Theft of Virtual Assets

BEIJING (March 29) - A Shanghai online game player stabbed to death a competitor who sold his cyber-sword, the China Daily said on Wednesday, creating a dilemma in China where no law exists for the ownership of virtual weapons.

Qiu Chengwei, 41, stabbed competitor Zhu Caoyuan repeatedly in the chest after he was told Zhu had sold his "dragon saber," used in the popular online game, "Legend of Mir 3," the newspaper said a Shanghai court was told on Tuesday.

"Legend of Mir 3" features heroes and villains, sorcerers and warriors, many of whom wield enormous swords.

Qiu and a friend jointly won their weapon last February, and lent it to Zhu who then sold it for 7,200 yuan (US$870), the newspaper said.

Qui went to the police to report the "theft" but was told the weapon was not real property protected by law.

"Zhu promised to hand over the cash but an angry Qui lost patience and attacked Zhu at his home, stabbing him in the left chest with great force and killing him," the court was told.

The newspaper did not specify the charge against Qiu but said he had given himself up to police and already pleaded guilty to "intentional injury."

No verdict has been announced.

More and more online gamers were seeking justice through the courts over stolen weapons and credits, the newspaper said.

"The armor and swords in games should be deemed as private property as players have to spend money and time for them," Wang Zongyu, an associate law professor at Beijing's Renmin University of China, was quoted as saying.

But other experts are calling for caution. "The 'assets' of one player could mean nothing to others as they are by nature just data created by game providers," a lawyer for a Shanghai-based Internet game company was quoted as saying.

And then? The moment you say that items and characters in games are 'real' to the law, and that theft of those items is a punishable crime it means that games like WoW die out. After all, if you kill a monster someone else attacked first, you can be sued for stealing the loot. If you kill another player you can be sued for manslaughter?

This case is difficult though, as the person made a profit from the time someone else had spent on the game. If you steal their account you steal something clearly worth money. But if you steal an account in a game like Diablo II? Only Blizzard can take action against that, and it's quite hard to prove.

THe online weapon stuff should have been handled by the game's support staff. But committing murder, he should get charged just like anyone else.

To me its the same as identity theft. People regulary go to prison 7+ years for that here in the states.

I don't care what people think of my post count. Most of its from helping people, and a lot of the more helpful members of the board already know that.

as for this case, well if it's worth money it could be deemed intelelctual property, kinda like stealing a novel, manuscript, poem, lyrics, computer program....but those are copyrighted and a friggin sword in an online game is not.

dumbass kid should have sold it himself. he only has himself to blame for letting his friend "borrow it" but sta@bbing someone over a friggin game is nuts. even if it is worth $850.

do a search. most of his posts do seem helpful.

but that just makes it even crazier. nef posts don't take any time, but helpful posts do.

and to the OP.......that dood needs to be locked up to get his head on straight. video games have clearly distorted his perception of reality. You cant go around stabbing ppl in real life like its a video game.
