Well I guess I got kind of lucky. My backordered phone shipped and I was also able to order another one, mostly because of their screw up. I actually ordered 3 total but only 2 showed up. When I called to complain they said they would give me credit for all 3 orders. Apparently, they didn't realize I had actually received 2 of the orders. Their system made it seem like none of them had been delivered.

Moral: If you got your backordered phone and haven't been charged you probably never will be.

My credit card was billed: $59.44 + $4.90 tax + $7.58 shipping.
It seems that OD doesn't keep their credit card info in their system, but does reconcile their backordered invoices when they ship.

Even if they didn't, can't they just send invoices to the backordered customers whose orders were fulfilled? After all, they do have our addresses.
