bought a watch described as
"Only very slight scratchs on band and NONE on the watch crystal."

There are two noticable scratches on the crystal; and the case/bracelet is beaten to hell. Scratches/deep gouges.


I emailed him requesting a refund.. we'll see what happens.

I've gotten some really good deals on watches from trusting individual sellers. The guy seemed fairly trustworthy and the fac that he noted that there were light scratches on the band led me to believe I wasn't getting ripped.
 
Was it sold as-is? If so, you're at the seller's mercy. PayPal won't do anything in this situation, I know firsthand unfortunately.

If the guy won't refund my money willingly I'll leave it as a neg and polish out as much of the gouges and scratches as I can.

This is a great watch. I have had it for about 3 years now. I recently purchased a new watch and no longer have a need for this one. It runs perfectly. Only very slight scratchs on band and NONE on the watch crystal. Has all the serial numbers intact. I could not find the additional links that came with the watch at purchase, but it is currently sized to an "average/small" wrist.

This watch was originally a few hundred dollars.

Just contact eBay about someoen who had a misleading auction. You can get a refund and send him the thing back. Just write Return to Sender on it so he has to pay the return shipping. Either that or contact Paypal if you used them for the sale. Both have protection things in place.

Not true. As is refers only to the other portions that have not been described. If an item is described as: good condition, few minor scrathces on band, crystal is perfect, as is means that in all other the respects the condition is as is.

If the item does not meet the conditions described then its not a valid transaction. I paid for x, you gave me y... Typical bait and switch fraud.

Do you know that first hand? I was in the similar situation about a year ago, where the item described as in "very good cosmetic condition" was anything but in good condition and PP denied my claim stating that they do not warrant physical appearance of the item.
