My sister got a speeding ticket a while back on February 15, 2004. Speeding 85 in 70, state of Florida, fine is $149! The cop actually said he gave it to her because she had a radar detector (it didn't go off) and FURTHERMORE, he actually wrote "Radar Detector!" in the comments where it says "Other Violations or Comments Pertaining to Offense. THIS WAS NOT AN OFFENCE! Radar Detectors are not ILLEGAL in Florida! BUT IT'S NOT OVER YET! When she called to say she was taking the drivers class, the County Clerk lost the ticket and finally found it APril 6th and now they sent her a letter saying pay by May 6.

Can't this get thrown out of court on so many technicalities? What can I fight it with? Discrimination against those who use radar detectors?

The detector is illegal in MN if its mounted on your winshield or on the dash... w/o reading this entire thread I had the same thing happen they lost the ticket a few months later they found it. I went to court once they found it lost in court and paid the fine.

You should definitely try to get it thrown out. Looking for a loophole is always better than taking responsiblity for your actions. It's what all deadbeat losers do. Good Luck!

STFU and get off your highhorse. 85 in a 70 is hardly worth the 150 dollar fine and the increase in insurance. What she did was about a .5 on the 1-10 scale of wrongness. Fricken people make me sick, traffic tickets most of the time are complete BS, and the cops should be out doing something productive.

It is an undeniable fact that people speed. Everyone does. I do. However, If I am speeding and get caught I try to get driving school if I don't get a warning. I don't post a thread about how/why I felt it was ok to speed that day, and that those damn cops should be out doing something else. Suck it up like the rest of us and deal or get a lawyer.

he just said "in this case, if there's no bent metal there's no broken law"

What does he think the outcome would be if I fired 6 shots around him but none hit?

That lawyer friend is an idiot. Reckless driving would be an 'easy' possibility if there was an attempted but unsuccessful sideswiping.

There is another thread I am in that a few people think if you are a salesman on a 1099 (contractor) you can't be held accountable for cheating customers as you don't work for the company, you are self-employed.

That's when you sick your insurance company on theirs. Who cares how fast other people are driving? The posted speed limit is the posted speed limit. If you break it and get a ticket, you're a moron.

If you get yourself into an accident because of you think it's ethically wrong to speed, YOU are the moron. Even if you are not at fault an accident will still cost you thousands of dollars in wasted time and increased insurance premiums. Technically what the police do is called entrapment if it involved any other crime, since they rarely enforce the law and seemingly encourage the breaking of it. However, it's not worth paying a lawyer thousands of dollars to fight a $100 ticket so they get away with it.

If you think that driving the speed limit will cause everyone else on the road to not see you and just plow right into the back end of your car, YOU are the moron. I drive slower than traffic all the time, thanks to the amazing innovation of multi-lane divided highways.

Yeah and stealing something cheap shouldn't even be a concern...it's *hardly* a crime right?

Here's the deal, and yes I have a problem following the rules sometimes, to levels much more than paying a simple fine....if I choose I cannot live with the consequences imposed by breaking the laws I do I need to vote to change that or leave the country. The idea of the laws we have is because we are not living all as individuals, we are living in a community called the USA...(at least for the scope of this discussion)....in some countries penalties are harsher and in some less/non-existant. Everyone can't just go around unrestricted...that would be anarchy.

You can argue that the penalty is too severe, but you cannot argue 'level' of wrongness...laws are lines in the sand, you can't almost speed, steal only a *little*, etc. Everyone is capable of finding out what the cost of the penalty will be ahead of time. The whole if you can't "do the time/pay the fine", don't do the crime thing is real.

By driving slower than flow you are the bigger MORON. More accidents and more serious ones happen due to someone driving slower than the flow of traffic. People have a hard time in motion telling when an object is even stopped in front of them.

Please use this in court.. and better yet, somehow video tape the entire incident for all of us to see the judge's reaction when you say that.. bwahaha... now that would make my day.

Hey genius, if I'm driving slower than the flow of traffic, I drive in the right lane. If people want to drive faster than me, there's two other lanes for them to do so in. If they feel the need to drive 90 mph in the right lane I can't do much about that, because I'm not going to risk getting a ticket so some guy I don't even know can sleep five minutes later. Sure you can show me plenty of statistics that show that accidents are caused by speed differentials, not high speeds. I could probably find you statistics that show an increase in fatal accidents when speed limits are increased, but as long as people keep to the RIGHT when they're driving slowly and to the LEFT when they're driving fast, the the degree of speed difference in adjacent cars will be minimal. I drive responsibly and cautiously, and I've never been in an accident.

Furthermore, I drive a 6 ton truck with the handling characteristics of a yacht. While it may be "safe" for people to drive their small cars 80 mph with less than 20 feet of following distance, it is not for me. I drive slowly for my safety as well as those around me.

Don't argue with me, argue with the facts. Whether you are in the left, middle or right if you are driving slower than the flow you are putting others at a greater risk than the 10-15mph speeder. Someone will perceive you moving faster and not know you arent until it is too late.

With you driving a huge truck the difference is not so bad as bigger objects appear to be moving slower anyway. If you were in a passenger car then it'd be a problem, in a truck not as much.

Also in America....lanes aren't followed like in foreign countries. People pass on the right, even shoulders...people turn right from the left lane and vice versa, etc. It's chaos on the roads and everyone thinks they are 'Do you know who I am?' types.
