OMG! This ticket can so get thrown out of court! Right?

My sister got a speeding ticket a while back on February 15, 2004. Speeding 85 in 70, state of Florida, fine is $149! The cop actually said he gave it to her because she had a radar detector (it didn't go off) and FURTHERMORE, he actually wrote "Radar Detector!" in the comments where it says "Other Violations or Comments Pertaining to Offense. THIS WAS NOT AN OFFENCE! Radar Detectors are not ILLEGAL in Florida! BUT IT'S NOT OVER YET! When she called to say she was taking the drivers class, the County Clerk lost the ticket and finally found it APril 6th and now they sent her a letter saying pay by May 6.

Can't this get thrown out of court on so many technicalities? What can I fight it with? Discrimination against those who use radar detectors?

Yes, use the discrimination defense. Hell, if you are non-white you have an even better chance of winning.

You should definitely try to get it thrown out. Looking for a loophole is always better than taking responsiblity for your actions. It's what all deadbeat losers do. Good Luck!

It's common knowledge that if you have a Radar detector, you ain't gonna get any breaks.
Basically by having one, you're telling law enforcement that you're trying to break the law.

No, the guy was "all pissey"sic because she was doing 15 miles per hour over the posted speed limit. Not one, not 5, but 15 miles per hour faster than she should have been.

The "but everyone else was doing it" defense is often used by my 3 yr old. Good luck with that.





 
You guys are all focusing on the radar detector part! What about the fact that it was turned in like two months late and she was told she didn't have to pay it and then she gets a letter???!!

Yip, when I wrote tickets as a cop in the air force, if the person i pulled over got mouthy i wrote every single word on the back of the ticket. When thier commander/judge received the ticket they would have a good understanding why i stuck it to them.

I didnt need their abuse. I was doing my job and giving you a citation for doing something wrong. Suck it up!

Okay, am I the only person who if/when I get a ticket will not be a hissy bitch and pay it? You break the law, its your problem. Like i said in other threads like this, I don't deny I speed, but I understand the consequences to it. I also don't speed like a madman unless a) Everyone around me is also speeding (not a defense, just saying if everyone else is doing 10 over the limit, so will I, and if I get singled out, big deal), and b) I am on a road where very little others are so I only endanger myself. Now, if I get caught speeding, or otherwise breaking the law, I am not going to find a technicality unless it exists (cop not using radar gun, writing down wrong license, wrong speed, etc...). If you broke the law, fess up to it, and move on with your life. If it is a point offense, take driving classes, and knock the points off.

I've been averaging two parking tickets a week (nothing I can do about it... I'm stuck inside my office from 8 am - 9 am; the meter guy comes around at 9:15 am, so if the morning shift guys are late to relieve me and I don't get out till 9:30 am... bam! ticket.). I'd never fight it, though, because hey -- the meter was unpaid. if you're going to break the law, be willing to accept the consequences.

in this case, I'm willing, because $50/week in parking tickets is still cheaper than parking in the private lot underneath my building for $15/day.
 
why does your sister have a radar detector if it doesnt work?



just pay the ticket, your sister was wrong for going 15 miles over the speed limit regardless of anything else

The problem with that point of view is that around here, you either break the law or you drive dangerously slow. If you drive under the speed limit on 66 or 495 you will get rear-ended.

Does your sister's detector come with one of those money-back guarantees that says the company will cover any tickets you get? If so, pay it and forward the cost to the company.
 
Why don't you talk to the DA and a lawyer.

Asking here will just get you a bunch of bullsh!t armchair lawyer answers.
