California ... yup.

Umm you dont want to go to court. Do a written contest. The cop doesnt get paid to write his report. Write your report. ATtach googlemaps, etc google earth.. yea whatever. If you go to court its your word against his and we know how well that works. Moreover, he gets paid to go to court to throw his BS out at you. The written report= win.

Where exactly did you get the ticket.. city, highway, etc

This is actually in Boston, MA on the highway. i-95 North. Anyways, I've just sent an appeal to court. I'm guessing that I'll receive some intructions as to what I will have to do next.

Normally theres a sign that says "construction ends" or "road work ends." If you didn't see that sign and it was actually posted, you're SOL.

If construction is still going on, I would go out there and take pictures of where the construction ends, and where you were in relation to that.

Good work. They will send instruction in the mail, but it might be good to call the court anyways...the receptionists are usually friendly.

Contesting it by mail also delays your proceedings for weeks, if not months. When you start sending official documents, like discovery requests, make sure to send it registered mail or certified mail (it's an extra $3, but you will have proof for the court that your mail was sent and recieved).

i'm wondering for all those who say "just pay it", if you were one of those other cars going w/ the flow of traffic and got randomly pulled over, would you "just pay it"?

I wouldn't whine about it like it's someone elses fault.

I'm not whining about it. I'm just asking for suggestions and advice for those that have been in similar situations or in the legal field. Read carefully.

We have a bridge replacement project going on. They erected a third temporary span between the two original bridges, and the process is that they tear down one bridge at a time and replace it, while diverting all the traffic onto the third, temporary bridge, which they then tear down. This is all neccessary, because the original bridges are circa the depression, and were built over a huge ravine with a river in the bottom, and are a single, VERY long span, with no pilings whatsoever. They're actually bowing. The new bridges are going to be 3 spans each and wider for future growth.

But anyway, the construction zone is TERRIBLY annoying. They installed the temporary so well (because it'll take so long to finish each bridge) that the temporary roadway and the pavement on the bridge is actually the same quality of a permanent highway here in MD. It's just as wide as normal, the only reason the speed limit drops to 45 from 65 is the general work zone safety, which is also relatively moot because the entire work zone is walled off with double-height jersey wall. Also, the manufacturer's recommended speed on the prefab bridge is 45mph. You can actually see the frustration as drivers slow down to as slow as they're comfortable (55ish) on the approach, only to be told that they're still speeding by the RADAR sign (not a camera, fortunately), and then they brake as they approach the sign trying to make it go ever lower. It's f'ing painful.

You got served. Doesn't matter if you're going w/ the flow, you were going 80mph, which is above the posted speed limit. Suck it up and pay the fine, you ain't gonna get off easy.

Construction zone speed trap

Classic

Cops love to stake these out. We have construction zones here where they work like once a month, but you see cops gathered there like flies on turds.

you can fight it, but it sounds like you're screwed.

You do realize no matter how guilty he is of speeding, the ticket can still be dismissed if the cop doesn't submit a written declaration or if they don't honor his discovery request, right?

For every ticket I've recieved that was dismissed, I was blatantly speeding. Hell I don't even go with the flow of traffic; sometimes I was the only car on the road when I was ticketed.

the construction ends where the sign says, End Road Construction (protestors I think place these 😉 ) but in all seriousness, if you were flowing with traffic and the speed limit sign says 65 when you pass it, then its 65

Double in construction zones

Ausm

Really? That's good to know because nobody else has pointed this out yet. 😉 😛

Poor Nik, he sticks his foot in his mouth and everyone rushes to get in atleast one kick to force it in further.

Chicago is putting up cameras in construction zones so your ticket comes in the mail now...

Which is why everyone needs to invest $20 in a license plate cover that blocks your plate from these cameras.

Anything covering the license plate is Illegal in Illinois.
I used to have a clear plastic "license plate cover" on my back plate to keep the plate from getting salt and rust, etc. I friggin got pulled over for it.

Sucks for you.

I bet you live in one of those gay states that are streamlined to take your money.

In Texas for example you can plead not guilty and have a trial by jury, however most states dont care about justice they only want your money so they dont let you have a trial much less a jury trial.

Also its not illegal to go over the speed limit in Texas.

Then try this instead.

Clear spray != covering.

damn straight up the butt
😉

Fixed for accuracy.

lmao!

Yeah, fight it. At the very least you'll end up just paying it. With any luck, you could get points/fine/etc.. reduced. First ticket, story... Might fall on a judges ears who's feeling good that day.

Edit: the price you'll pay in insurance increases makes it worth at least trying

something is wrong with nik, he's not up to form today.... i'll take over for him.

ahem...

to op, you broke the law so suck it up and pay the fine, or hire a lawyer.
would it make you feel better if they have a squadron of cops and stop everyone else too?

🙂 I think people with other threads already exhausted Nik's supply of asshole-ish comments for the day (hopefully).
