OMG! fined $700.00 for speeding ticket.

So I was on the highway right passing through the construction zone. All of a sudden, the traffic halts for a good 5 minutes due to some contruction proceeding. Soon the policemen, allowed the flow of traffic back on the highway. The two lanes split into four, and I thought that we were out of the construction zone. Being stuck in traffic for a bit, I see that everyone around me started to speed just as I did. I was going at 80 mph thinking that we were out of the construction zone where the speed limit was 65 mph.

As I crossed the first underbridge... sirens go off and I was pulled over. WTF? I was going with the flow of traffic and I was pulled over. The cop said I was speeding in the construction zone where the speed limit was 45 mph so the fines double. There is no fvcking way I'm paying for this. I'm appealing it and going to court soon. What should I say. This is my first speeding ticket BTW. Any help or advice will be greatly appreciated.

Normally theres a sign that says "construction ends" or "road work ends." If you didn't see that sign and it was actually posted, you're SOL.

If construction is still going on, I would go out there and take pictures of where the construction ends, and where you were in relation to that.
 
Were there any posted speed limit signs where you got pulled over?

Acknowledge that you were going 80, but say that you were well out of the construction zone at the time.
 
Were you in the constructions zone? If you didn't pass a sign saying "end construction" or a sign that had a faster speed limit on it, you were still in the construction zone. In which case you are screwed, the "everybody else was doing it" defense doesn't usually work too well.

Sorry, but there's not a lot you can do.
 
They will have you talk to the DA, since it is your first ticket they will probably lower it to a non-moving violation like parking on the side of the road.

Expect to pay around $250. and get 3 or more points on your license.
 
You might want to get pictures of where you were pulled over to show the judge you were out of the construction.

Honestly, your chances of getting it dropped or reduced are pretty slim. Since it's your first ticket, just take defensive driving.

Even then, fines double in construction zones, not the offense. If anything, it would have been 15 over the limit with double the fine, not double the rate over the limit with the standard fine for that much over.

Unless the fine for 15 over the limit is 350, I'd fight to at least bring it down.
 
It was probably state police (since you were on a highway). That's good because those bastiges are more lazy than city pigs.

First, enter a not guilty plea (by mail if possible).

Second, request a trial by affadavit (aka a trial by written declaration).

Third, submit a discovery request for all pertinent info (radar/lidar calibration records, officer equipment certification records, state policies on radar/lidar use, etc.).

And proceed from there. Your next step depends on if they honor your request for discovery or ignore it.

By fighting the ticket, you at least have a *chance* to have it dismissed. If that chance is there, why not take it?

Or you can do what most of the idiots here will tell you to do...plead guilty, pay a huge fine, and take it up the butt from the state and your insurance company.
 
You must live in California.

Around here, there's a major road. Three lanes in each direction. They put up signs saying that fines are doubled in construction zones an all that. Construction is nowhere to be found. But 8' off the side of the road is a 1'x1' sign saying 25MPH. Traffic was very light, and I had a hard time finding the speed limit sign from the right hand lane. Someone in the middle won't even know.

A cross street near that one has another major road, 4 lanes in each directon. They have one of those construction speed limit signs up there, for the last year or so. It's almost a mile from where there is actual construction. But the speed limit lowers to 35MPH, and if you happen to turn off of the aformentioned road onto this one, you don't see it at all because it's more than 100 yards before the major intersection.

Tickets==taxes.

California ... yup.

Umm you dont want to go to court. Do a written contest. The cop doesnt get paid to write his report. Write your report. ATtach googlemaps, etc google earth.. yea whatever. If you go to court its your word against his and we know how well that works. Moreover, he gets paid to go to court to throw his BS out at you. The written report= win.

Where exactly did you get the ticket.. city, highway, etc

Do you know anything about the rules of the road?

In a construction zone, typically the speed limit is reduced. In this case it was reduced from 65mph to 45mph. So it's the same thing as him doing 80mph on a residential road with a limit of 45mph. So that's 35mph over (reckless driving), which in some places means immediately being brought down to the station, and having your car impounded.

On top of that, fines in a construction zone are doubled.

Which is why everyone needs to invest $20 in a license plate cover that blocks your plate from these cameras.

In all my years of driving, getting tickets, beating tickets in court, or losing my case in court, I have never seen a judge impose a fine greater than the original ticket for someone who tried to dispute it. Not in my cases or in the cases of all the people I watched while in court.
