Damn the old messages were deleted since the guitar was sold about 2 months ago and UPS took more than a month to process the claim

A: Full refund of $400 for the guitar; you return it to him.

or

B: You get the $ equivalet to the actual repair cost for the guitar.


If it is neither of those, CHARGEBACK all the way.

Yeah guy has some serious flaw in his logic or just greedy. He's entitled to $400 and that's it (unless you want a full refund, he should also pay for return shipping if that's the case. No money should come out of your pocket if return is due to damage during shipping). If he's not greedy then he's forgetting the buyer is not getting a product sold as described and he(the seller) got exactly what he wanted ($400) since the beginning.

I'd say if the buyer paid for insurance, he's entitled to the full $300 regardless of how much the repair actually costs.

I'd say if the buyer paid for insurance, he's entitled to the full $300 regardless of how much the repair actually costs.

It was the free insurance that UPS gives (not anything that I paid or the seller)

He either needs to offer you a full refund (which he has) or send you the insurance amount if you both agree to do that. You both come out fine either way in that scenario. NOW, what he's TRYING to do is help you both come out ahead on the shipping company's dime. He thinks the damage is less than $100 and is giving you *wink* *wink* $100 to cover them and keep a little something for yourself. Of course, he's being too greedy and/or doesn't know the extent of the damage and hoping to come out WAY ahead, so you should take the refund.

One of two things should happen:
#1: You return the guitar to the seller, he refunds you the $400
#2: You keep the guitar, the seller sends you the $300 in insurance money

$300+broken guitar=$400, just work out who is on what side of that equasion.

why does he not send you the 300 insurance check. This guy must think YOU lack common sense or something. Hes already got his money. He just wants more, thats all. I say you take a stab at screwing him and do a paypal dispute or chargeback.

I know what you said. I'm saying option #1 or #2 is fair to me but the third option he proposed doesn't make any sense.

IIRC, a chargeback against Paypal won't do you anygood, unless the douchebag has the $$$ available in his account...right? Did you pay with a credit card? If so, I'd go through the credit card company to do the chargeback, and file with Paypal as well, just to cover your ass...

yes I did use a credit card, so I guess ill chargeback through that then? (Unless it can take more than just the cash in the paypal accnt)

If you do a charge back his account will go into a negative balance and they will send the bill collectors after him if he doesnt make his account positive in 90 or so days.
