Ok UPS has gone through

The story is that I received a damaged guitar from this seller (message below) for $400 shipped. Since it was UPS' fault, they agreed to send $300.00 for the repair. UPS sends the money to the seller of the guitar, not the recipient (for some odd reason).

Basically, my question is this: (Read the quoted message first)
Isnt it only fair that I get to keep the guitar + get $300.00 in cash (to use for repairs) than for the seller to get my $400.00 (that I sent) and the $300.00 (that UPS sent?)

My take on this:
I should be able to keep the $300.00 from UPS in order to repair my guitar (which will cost $350.00)
He still KEEPS the $400.00 that I sent him for the guitar that I bought from him
So how is it fair that he gets to keep the $400.00 and the guitar while I get $300.00 (which is $100.00 less than what I bought the guitar for)

I am willing to provide a refund, provided that you send the guitar back. I think that this is a more than fair rembursement since you are getting a full refund. I think that we should both consider ourselves pretty lucky that UPS payed the full amount of the insurance claim; and that you are getting a full refund. So please box the guitar properly and insure it; and send it to me within 2 weeks. Upon receiving it, I will promptly refund you the full amount ($300) through PayPal. Or I can remburse you a partial ($100) refund if you keep the guitar.

I just got back from some vacation type thing and he sent me back a message

I'll give him 1 more chance to just give me the full cash or I'll chargeback

If you decide not to return the guitar to receive the full refund ($300), the only other option is a partial rembursement since you are keeping the guitar.

If I send you a full refund you are getting a free guitar. The guitar is still very playable, and doesn't need to be fixed to be used other than for a cosmetic reason. Give me your decision asap.

I don't seem to see the logic from your point of view. Regardless of whether or not I get a "free" guitar (I'm losing $100), it's still going to have a "cosmetic" problem. If I send you the guitar then I get a net loss of 15 bucks (shipping). (this is not my main point though)
After sending the guitar, you will get to keep my $400 and $200. (This makes no sense)

I do not wish to chargeback the money, but it may become my last resort following the next message. I have asked many people and they agree that your point of view is skewed.

First, UPS sending the money to the shipper makes complete sense.

Second, the seller is an idiot. Explain to him why he is a moron. If he does not comply, file a grievance with PayPal to get your $400 back and send him the guitar back.
 
What is the value of the actual damage done to the guitar? If it takes $300 to repair the guitar, then you should get the $300, repair the guitar and then you essentially have what you paid for. If on the other hand, the damage is not significant, and / or you don't intend to repair the guitar, then you should share the insurance with the seller simply to settle this and move on.

??? That guy must be high or something. How are you getting free money if it costs $300 to repair? He's offering $100 as a partial refund or only $300 for the full amount? Good luck with that...he should also pick up shipping from your end or at least split it with you and refund you the $400...

Maybe I am reading it wrong...

He is saying by the looks of it to me, "Look, give me the guitar back, you get your money back, no harm done."

If you want to keep the guitar, you could say... "No, i want to keep the guitar but have it repaired here. Could you please mail me the $300 in insurance to get the guitar fixed?"
 
why don you just file a paypal dispute and get over with it. Just say that item is significantly different from what was described.

Buy a new one with the refund that you get.
 
You should either get to keep the guitar and get the $300 insurance money, or you should just get your original $400 back. I'd have another chat with the seller to see what he is thinking.

meh, tell him the intial agreement was that he woudl send you the insurance check for the repairs. You have the mesasages saved. Otherwise, just file a chargeback and keep the guitar

2) You get nothing and lose nothing. He gets back a broken guitar and $300 for repairs.

Either or the two options above are fine and "fair".

The last option doesn't make sense.
 
If insured shipping was included in his auction, then he should refund you that charge, since the item didn't arrive in the condition he advertised. He should either forward to you the $300 for repairs, or refund your payment - including shipping.

The REPAIR COST = >>$350.00<< (Although I may be able to get it down a little and pocket it)
 
I'm confused now, but I believe you should be getting back your $400 not $300 when and if you return the guitar. Seller sounds like a 14 year old.
